3 AN ORDINANCE TO ABANDON THE TWENTY (20)-FOOT WIDE
4 NORTH/SOUTH ALLEY RIGHT-OF-WAY LOCATED WITHIN BLOCK
5 4, CLARK'S ADDITION, TO THE CITY OF LITTLE ROCK, ARKANSAS
6 (G-23-443); AND FOR OTHER PURPOSES.

8 WHEREAS,a request was made to abandon the twenty(20)-foot wide north/south alley right-of-way
9 located within Block 4, Clark's Addition, in the City of Little Rock, Arkansas; and,
10 WHEREAS, the Board has determined that the abandonment of the aforementioned easement will
11 not have an adverse impact on the adjacent property owners or the public welfare and safety;
12 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
13 OF LITTLE ROCK,ARKANSAS:
14 Section 1. The Board of Directors hereby releases, vacates, and abandons a twenty (20) feet wide
15 north/south alley right-of-way located within Block 4, Clark's Addition, being bounded by West 23rd,
16 West 24'h,Arch and Gaines Streets.
17 Section 2. The alley will be abandoned as a public right-of-way; however, the utilities have
18 requested that all or part of the abandonment be retained as a utility easement, an easement will be
19 maintained within the alley for storm water drainage areas.
20 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
21 records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
22 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
23 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
24 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
25 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
26 of the ordinance.
27 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
28 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
