Home My WebLink About20894 1 ORDINANCE NO. 20,894 2 3 AN ORDINANCE TO AMEND SECTION 36 OF THE LITTLE ROCK 4 CODE OF ORDINANCES TO ADD MOBILE FOOD TRUCKS AS A 5 PERMITTED USE IN CERTAIN ZONING CLASSIFICATIONS; TO ADD 6 MOBILE CANTEEN UNITS AS A PERMITTED USE IN CERTAIN 7 ZONING CLASSIFICATIONS; TO PROVIDE FOR FURTHER 8 REGULATION OF MOBILE FOOD TRUCKS; AND FOR OTHER 9 PURPOSES. 10 11 WHEREAS, mobile food trucks have experienced a marked rise in popularity across the country and 12 here in the City of Little Rock in the past few years, and 13 WHEREAS, mobile food trucks are able to dispense a large variety of foods, healthy meal options, 14 and foods from diverse cultural backgrounds to all areas of the City, including underserved areas,and 15 WHEREAS, mobile food trucks provide entrepreneurial opportunities for small and minority-owned 16 business operators,and 17 WHEREAS, the City now finds it desirable to set forth regulations to allow mobile food trucks to 18 operate within the city under certain circumstances and to establish regulations concerning mobile food 19 truck operations in order to protect the health, safety and welfare of the City's inhabitants. 20 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 21 OF LITTLE ROCK,ARKANSAS: 22 Section 1. Section 36-3 of the Little Rock Code of Ordinances is hereby amended to add a definition 23 of mobile canteen unit as follows: 24 (a) Mobile canteen unit means a vehicle, including mobile food trucks, mobile food trailers, and 25 push carts, offering food products or beverages for sale to consumers. 26 Section 2. Section 36-299(c)(1)of the Little Rock Code of Ordinances is hereby amended to add as a 27 permitted use within the C-1 zoning classification "mobile canteen units when operated in compliance 28 with current planning department regulations for such vehicles". 29 Section 3. Section 36-300(c)(1)of the Little Rock Code of Ordinances is hereby amended to add as a 30 permitted use within the C-2 zoning classification "mobile canteen units when operated in compliance 31 with current Planning and Development Department regulations for such vehicles". 32 Section 4. Section 36-301(c)(1) of the Little Rock Code of Ordinances is hereby amended to add as a 33 permitted use within the C-3 zoning classification "mobile canteen units when operated in compliance 34 with current planning department regulations for such vehicles". Section 36-302(c)(1)of the Little Rock Code of Ordinances is hereby amended to add as a 2 permitted use within the C-4 zoning classification "mobile canteen units when operated in compliance 3 with current planning department regulations for such vehicles". 4 Section 6. Section 36-279(c)(1) of the Little Rock Code of Ordinances is hereby amended to add as a 5 permitted use within the 0-1 zoning classification "mobile canteen units when operated in compliance 6 with current planning department regulations for such vehicles". 7 Section 7. Section 36-280(c)(1)of the Little Rock Code of Ordinances is hereby amended to add as a 8 permitted use within the 0-2 zoning classification mobile canteen units when operated in compliance with 9 current planning department regulations for such vehicles. 10 Section 8. Section 36-281(c)(1)of the Little Rock Code of Ordinances is hereby amended to add as a 11 permitted use within the 0-3 zoning classification mobile canteen units when operated in compliance with 12 current planning department regulations for such vehicles. 13 Section 9. Section 36-319(c)(1)of the Little Rock Code of Ordinances is hereby amended to add as a 14 permitted use within the I-1 zoning classification "mobile canteen units when operated in compliance 15 with current planning department regulations for such vehicles". 16 Section 10. Section 36-320(c)(1) of the Little Rock Code of Ordinances is hereby amended to add as 17 a permitted use within the 1-2 zoning classification "mobile canteen units when operated in compliance 18 with current planning department regulations for such vehicles". 19 Section 11. Section 36-321(c)(1) of the Little Rock Code of Ordinances is hereby amended to add as 20 a permitted use within the 1-3 zoning classification "mobile canteen units when operated in compliance 21 with current planning department regulations for such vehicles". 22 Section 12. The Planning and Development Department shall develop regulations concerning the 23 placement and operation of mobile canteen units to address, but not be limited to, the issues of hours of 24 operation,parking, and health. 25 Section 13. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 26 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 27 adjudication shall not affect the remaining portions of the ordinance, which shall remain in full force and 28 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 29 ordinance. 30 Section 14. Repealer.
