CODE § 34-4 4 (1988), DEFINITIONS, TO EXTEND THE AGE LIMITATIONS OF 5 EXECUTIVE SEDANS, EXTENDED VANS, LUXURY VEHICLES, AND 6 SUVS UNDER THE TRANSPORTATION CODE; TO DECLARE AN 7 EMERGENCY; AND FOR OTHER PURPOSES. 8 9 WHEREAS, on November 18, 1997, the City adopted a new Transportation Code, codified at 10 Little Rock, Ark., Rev. Code § 34-1 to § 34-97 (1988), that governs transportation franchises of vehicles 11 for hire,and 12 WHEREAS, over the past several years, poor economic conditions have financially affected 13 some ground transportation service operators' ability to replace their ground transportation service 14 vehicles after the 8`h model year as required by the Transportation Code, and 15 WHEREAS, in some cases, the ground transportation service vehicle which had reached the 16 removal point pursuant to the Transportation Code was in excellent condition,and 17 WHEREAS, there is now a desire to amend the Transportation Code to extend the age 18 limitations of executive sedans, extended vans, luxury vehicles, and SUVs. 19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE 20 CITY OF LITTLE ROCK,ARKANSAS: 21 Section 1. Little Rock, Ark., Rev. Code § 34-4 (1988), Definitions, Executive sedan, is hereby 22 amended as follows: 23 Executive sedan shall mean a sedan vehicle that has a manufacturer's suggested base 24 retail selling price of not less than that of a Cadillac Sedan de Ville, Lincoln Town Car 25 sedan or similar vehicle, excluding the cost of any manufacturer installed options or of 26 any modifications or conversions that were made by other persons following the original 27 assembly of the vehicle by the manufacturer. An executive sedan shall be four(4) model 28 years old or newer when initially inspected to be placed into service and shall be removed 29 from service at the end of its 10th model year. 30 Section 2. Little Rock, Ark., Rev. Code § 34-4 (1988), Definitions, Extended van, is hereby 31 amended as follows: 32 Extended van shall mean a van with a manufacturer's rated passenger capacity of fifteen 33 (15) persons, including the driver. An extended van shall be four (4) model years old or [Page 1 of 3i 1 newer when initially inspected to be placed into service and shall be removed from 2 service at the end of the 10th model year. 3 Section 3. Little Rock, Ark., Rev. Code § 34-4 (1988), Definitions, Luxury vehicle, is hereby 4 amended as follows: 5 Luxury vehicle shall mean an executive sedan, SUV, extended van or an antique vehicle 6 and shall not include a limousine. The above vehicles, other than antique vehicles, shall 7 be four (4) model years old or newer when initially inspected to be placed into service 8 and shall be removed from service at the end of their 10`h model year. 9 Section 4. Little Rock, Ark., Rev. Code § 34-4 (1988), Definitions, SUV, is hereby amended as 10 follows: 11 SUV shall mean a vehicle that is classified in the United States Environmental Protection 12 Agency's annual fuel economy guide as a sport-utility vehicle that: 13 (i) Has a passenger capacity of not less than six (6) persons nor more than nine (9) 14 persons, including the driver, and 15 (ii) Has a manufacturer's suggested base retail selling price of not less than that of a 16 two (2)-wheel drive Ford Expedition, Chevrolet Suburban, or similar vehicle, 17 excluding the cost of any manufacturer installed options or of any modifications 18 or conversions that were made by other persons following the original assembly 19 of the vehicle by the manufacturer. 20 An SUV shall be four (4) model years old or newer when initially inspected to be 21 placed into service and shall be removed from service at the end of its 10th model year. 22 Limousines are excluded from the definition of SUV. 23 Section 5. Severability. In the event any section, subsection, subdivision, paragraph, 24 subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be 25 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining provisions of 26 this ordinance,as if such invalid or unconstitutional provision was not originally a part of this ordinance. 27 Section 6. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with 28 this ordinance are hereby repealed to the extent of such inconsistency. 29 Section 7. Emergency. Since the City's Transportation Code was intended to be a 30 comprehensive codification of ordinances dealing with for-hire transportation within the City of Little 31 Rock, Arkansas, and such regulation is essential to protect the public health, safety and welfare, an 32 emergency is declared to exist and this ordinance shall be in full force and effect from and after the date 33 of this adoption.
