RESOLUTION NO. 4 13,527 (JULY 3, 2012), TO CLARIFY THE TYPE OF EASEMENTS THAT 5 MAY BE ACQUIRED BY THE CITY FOR THE 2012 3/8-CENT 6 DRAINAGE SYSTEM IMPROVEMENTS LOCATED AT VARIOUS 7 LOCATIONS THROUGHOUT THE CITY OF LITTLE ROCK, 8 ARKANSAS; AND FOR OTHER PURPOSES. 9 10 WHEREAS,the Public Works Department initiated a 2012 3/8-Cent project to construct and maintain 11 new drainage improvements throughout the City; and, 12 WHEREAS,Little Rock,Ark. Resolution No. 13,527(July 3,2012), authorized the City's acquisition 13 of certain easements in order to access areas of drainage facility construction and to maintain the drainage 14 improvements; and, 15 WHEREAS,an amendment to Resolution No. 13,527 is needed to clarify the authorization granted by 16 the Little Rock Board of Directors to acquire construction easements. 17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK,ARKANSAS: 19 Section 1. Section 1 of Little Rock, Ark. Resolution No. 13,527 (July 3, 2012) is hereby amended to 20 authorize the acquisition of permanent drainage easements by the Mayor and the acquisition of temporary 21 construction easements by the City Manager; to correct a reference to Resolution No. 12,422; and to read 22 as follows: 23 Section 1. In order to construct and maintain the 2012 3/8-Cent Drainage System 24 Improvements outlined in Resolution No. 13,442, adopted by the Board of Directors on 25 February 7, 2012, the City Manager is hereby authorized to acquire needed temporary 26 construction easements, and the Mayor is hereby authorized to acquire needed permanent 27 drainage easements. 28 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 29 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 30 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 31 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 32 resolution.
