3 AN ORDINANCE TO ABANDON EAST 25T" STREET AND
4 CUMBERLAND STREET RIGHT-OF-WAY, BETWEEN EAST
5 ROOSEVELT ROAD AND EAST 25T" STREET, EAST OF SCOTT
6 STREET(G-23-442); AND FOR OTHER PURPOSES.

8 WHEREAS, the adjacent property owners propose to abandon the East 140 feet of the undeveloped
9 sixty (60) foot wide East 25th Street right-of-way lying north of Block 5 of the Subdivision of Lot 18 of
10 Rapley's Estates Addition, and 130 feet of the undeveloped sixty(60)-foot wide Cumberland Street right-
11 of-way located between East Roosevelt Road right-of-way and East 25th Street right-of-way, pursuant to
12 the City's general police power authority under Ark. Code Ann. § 14-54-104; and,
13 WHEREAS, the Board has determined that the abandonment of the aforementioned easement will
14 not have an adverse impact on the adjacent property owners or the public welfare and safety;
15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK, ARKANSAS:
17 Section 1. The Board of Directors hereby releases, vacates, and abandons the East 140 feet of the
18 undeveloped sixty (60)-foot wide East 25th Street right-of-way lying north of Block 5 of the Subdivision
19 of Lot 18 of Rapley's Estates Addition, and 130 feet of the undeveloped sixty(60)-foot wide Cumberland
20 Street right-of-way located between East Roosevelt Road right-of-way and East 25th Street right-of-way
21 in the City of Little Rock, Arkansas.
22 Section 2. None of the public utilities request the area be retained as a utility easement, and drainage
23 easements shall be maintained in the right-of-way to convey storm water from adjacent property.
24 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
25 records of the recorder of the Circuit Clerk in ex-officio recorder of Pulaski County, Arkansas.
26 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
27 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
28 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
29 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
30 of the ordinance.
31 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
32 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
