192101 2 ORDINANCE NO. 19f210 2004087243 3 AN ORDINANCE TO ESTABLISH THE RATE OF TAXATION OF 4 PROPERTY FOR THE CITY OF LITTLE ROCK FOR THE YEAR 2005 5 FOR VARIOUS FUNDS OF THE CITY OF LITTLE ROCK, 6 ARKANSAS; TO DECLARE AN EMERGENCY; AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, state law mandates that the county quorum court adopt an 10 ordinance prior to the end of the year which establishes the various millage rates for 11 assessments on real and personal property for the coming year, and 12 WHEREAS, on November 4, 2003 the voters of the City of Little Rock authorized 13 the issuance of limited tax general obligation bonds for the purpose of capital 14 improvements within the City, 15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 16 OF THE CITY OF LITTLE ROCK, ARKANSAS: 17 Section 1. The rate of taxation of real and personal property in the City of 18 Little Rock, Arkansas for certain City purposes is hereby fixed, established and levied as 19 follows: 20 (a) For general purposes in order to carry on the affairs of the 21 City Government under Section 4, Article 12 of and Amendment 10 to the 22 Constitution of Arkansas of 1874, there is hereby levied a tax of five (5) 23 mills; 24 (b) For the purpose of paying bonds and interest as may be 25 required for the bonds authorized in Little Rock, Ark., Ordinance No 26 18,941 (September 30, 2003), to repay the City of Little Rock, Arkansas, [PAGE 1 OF 3] ORDINANCE Rate of Little Rock Property Tax for 2005 1 Capital Improvement Bonds, approved at a special election held on 2 November 4, 2003, there is hereby levied a tax of three and three tenths 3 (3.3) mills; 4 (c) For the purpose of paying Policemen's Pensions in 5 accordance with provisions of Amendment No. 31 to the Constitution of 6 the State of Arkansas, a tax of one (1) mill; 7 (d) For the purpose of Paying Firemen's Pensions in accordance 8 with the provisions of Amendment No. 31 to the Constitution of the State 9 of Arkansas adopted November 5, 1940, and Act 16 of the acts of the 10 General Assembly of the State of Arkansas for the year 1941, a tax of one 11 (1) mill; 12 (e) For the purpose of maintaining the City Library, in 13 accordance with the provisions of Amendment No. 30 to the Constitution 14 of the State of Arkansas, a tax of two and eight tenths (2.8) mills; 15 (f) For the purpose of paying bonds and interest as may be 16 required for the City of Little Rock, Arkansas, for Library System Capital 17 Improvement Bonds, a tax of one (1) mill. 18 Section 2. Since the City achieved equalization in 1989 under the provisions of 19 Amendment 59 to the Arkansas Constitution, the tax rates are the same for both real 20 and personal property. 21 Section 3. Because Pulaski County completed a county -wide reappraisal of 22 property in 2003 it is possible that the millage rates set forth in Section 1 of this 23 Ordinance will be subject to the rollback provisions of Amendment 59 as determined by 24 the Arkansas Assessment Coordination Department; therefore, to the extent that the 25 millage rates in Section 1 are ordered roll backed in accordance with state law the Board 26 of Directors adopts and ratifies such millage rates. The City Clerk is hereby directed to transmit a certified copy of this 2 Ordinance to the County Clerk of Pulaski County so that the taxes recited may be 3 extended on the tax books of Pulaski County and collected with the other taxes for the 4 year 2004. 5 Section 5. Severability. In the event any title, section, paragraph, item, 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 6. Repealer. All ordinances and resolutions, including by not limited to Little Rock, Ark., Ordinance No. 19,011 December 16, 2003) ( "the 2004 Budget Ordinance "), are hereby repealed to the extent of such inconsistency. Section 7. Emergency. It is essential to the public health, safety and welfare that the proper millage rates be stated each year, and that this information be promptly communicated with the Pulaski County government in order to assure that appropriate tax millages are put into effect for the following calendar year, an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
