PULASKI COUNTY CIRCUIT/COUNTY CLERK Fees$20.00 1 RESOLUTION NO. 13,837 2 111111{ 3 A RESOLUTION TO AUTHORIZE THE USE OF ALL NECESSARY •II��� ciRc�� 4 MEASURES TO ASSURE ACCESS TO PROPERTY FOR RENOVATION �Y 5 AND IMPROVEMENTS TO ROBINSON CENTER AUDITORIUM; AND 11 6 FOR OTHER PURPOSES 4 it 7 �/ -0U1 56' lilllllllll 8 WHEREAS,on December 10,2013,the voters of the City of Little Rock approved the City's issuance 9 of bonds to finance renovation and improvements to the Robinson Center Auditorium(the"Improvement") 10 and on December 20, 2013, the results of this election were certified by Pulaski County Election 11 Commission; and, 12 WHEREAS, a small portion of the property necessary for the Improvement is subject to a Construct 13 and Lease, Parking and Concession Agreement (the "Lease") executed by and between the City of Little 14 Rock and Capitol City Hotel Limited Partnership, and more particularly Section 24.1 of the agreement, 15 commonly referred to as the Doubletree Hotel; and, 16 WHEREAS, it is necessary to acquire an unencumbered title to this certain tract conveyed by the 17 Lease for the Improvement; 18 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 19 OF LITTLE ROCK,ARKANSAS: 20 Section 1. The City Attorney is hereby authorized to pursue all appropriate measures to obtain 21 unencumbered title to the below referenced property, preferably through negotiation, but also to use all 22 other statutory powers available if necessary;the property in question is more fully described as: 23 Tract B: All that portion of the following described parcel of land above or over the 24 elevation of 285.0 feet above Mean Sea Level Datum, including the columns, footings, 25 foundations and supports to be constructed below or beneath the elevation of 285.0 feet 26 above Mean Sea Level Datum, said parcel being bounded and described as follows: 27 Beginning at the intersection of the east edge of the Broadway Bridge with the south right- 28 of-way of Garland Street said point being approximately 11 feet west of the northwest 29 corner of Lot 6, Block 100, Original City of Little Rock, Arkansas; thence north fifty-one 30 (51)feet along said east edge of the Broadway Bridge to its intersection with the south curb 31 line of La Harpe Boulevard; thence east 156.0 feet. along said south curb line to a point; 32 thence south fifty-one(51)feet to a point on the south right-of-way of Garland Street,said 33 point being five (5)feet west of the northeast corner of Lot 4, Block 100; thence west 156 [Page 1 of 2] 1 feet along said south right-of-way of Garland Street to the point of beginning, all in the 2 County of Pulaski, State of Arkansas. 3 Section 2. The City Manager is hereby authorized to negotiate on behalf of the City,and for the benefit 4 of the Little Rock Advertising & Promotion Commission, to obtain the necessary property without the 5 necessity of any further action, and the City Clerk and the Mayor are authorized to execute any and all 6 documents necessary to carry out the purposes of this resolution. 7 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 8 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 9 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 10 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 11 resolution. 12 Section 4. Repealer.
