13823 1 RESOLUTION NO. 13,823 2 3 4 A RESOLUTION AUTHORIZING AN INCREASE TO THE 5 AUTHORIZED CONTRACT AMOUNT FOR MELCHOR 6 CONSTRUCTION FOR THE 2012 CDBG SIDEWALK REPAIR AND 7 IMPROVEMENT PROGRAM ON BATTERY, STATE, MARSHALL AND 8 WOLFE STREETS; AND FOR OTHER PURPOSES. 9 10 WHEREAS, Resolution No. 13,369 and No. 13,383, authorized funding under the CDBG Program 11 for sidewalks repairs and improvements on Battery, State, Marshall and Wolfe Streets, 12 WHERAS, favorable bid prices from Melchor Construction, Bid No. 13-147, will allow for the 13 construction and replacement of additional sidewalk within the project area. 14 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 15 OF LITTLE ROCK,ARKANSAS: 16 SECTION 1. The City Manager is hereby authorized to approve an amendment to the contract with 17 Melchor Construction for additional sidewalk on Battery, State,Marshall and Wolfe Streets in the amount 18 of Twenty-Nine Seven Thousand, Six Hundred Forty-Five and 10/100 Dollars ($29,645.10) and by this 19 amendment, the new contract will increase from the previously-authorized Forty-Five Thousand, Three 20 Hundred Twenty-Seven and 70/100 Dollars($45,327.70)to the maximum amount of Seventy-Four Three 21 Thousand,Nine Hundred Seventy-Two and 80/100 Dollars($74,972.80). 22 SECTION 2. Funding for this project is available from the CDBG Grant Program, Resolution No. 23 13,369 and No. 13,383. 24 SECTION 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, 25 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 26 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 27 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 28 resolution. 29 SECTION 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 30 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency. 31 SECTION 5.
