S; ,,�;ti 13 °o *� Gyp RKANSpc? 14 WHEREAS, St. Andrew United Methodist Church owns property with improvements located at,m1,„` 15 4600 Baseline Road in Little Rock, Arkansas, and is willing to lease the property for use by the Little 16 Rock Housing and Neighborhood Programs Department (the "Department") as a Neighborhood Alert 17 Center and for the purpose of holding meetings of the Upper Baseline Community Association and other 18 similar public meetings approved by the Department; and, 19 WHEREAS, improvements must be made to the building prior to its use as a Neighborhood Alert 20 Center;and, 21 WHEREAS, St. Andrew United Methodist Church has offered to reimburse the City for the cost of 22 these improvements by waiver of the monthly rental fee in increments of Five Hundred Dollars ($500.00) 23 until the amount expended by the City is repaid in full, and then at such time for free rent for the Term of 24 the Lease, and any extension and renewal Terms thereof; and, 25 WHEREAS, the Little Rock Board of Directors recognizes the importance of providing an Alert 26 Center in the Baseline Road area and desires to make needed improvements to the property at 4600 27 Baseline Road in exchange for free rent for the Term of the Lease, and any extension and renewal Terms 28 thereof, after such time as the improvement fee has been repaid by St. Andrew United Methodist Church. 29 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 30 OF LITTLE ROCK. ARKANSAS: 31 Section 1. The Board of Directors hereby authorizes the City Manager, Mayor and City Clerk to 32 execute a Lease Agreement with St. Andrew United Methodist Church, in a form approved by the City 33 Attorney, for the Lease of real property and improvements located at 4600 Baseline Road in Little Rock IPage 1 of 21 1 for use as a Neighborhood Alert Center and for the purpose of holding meetings of the Upper Baseline 2 Community Association and other similar public meetings approved by the Department for five(5)years, 3 with a right to extend the Term of the Lease annually for two (2) additional Terms of one (1)-year each 4 from and after the expiration of the initial Term, or any renewal or extension Term, upon the same terms, 5 covenants, agreements and conditions as set forth in the Lease Agreement; for a property improvement 6 fee not to exceed Ten Thousand Dollars ($10,000.00), to be reimbursed by waiver of the monthly rental 7 fee in increments of Five Hundred Dollars ($500.00) until such time that the City's improvement costs 8 have been repaid in full, and then at such time for free rent for the remainder of the Term of the Lease, 9 and any extension and renewal Terms thereof. 10 Section 2. Funds for the improvement payment not to exceed Ten Thousand Dollars($10,000.00)are 11 available from the Housing and Neighborhood Programs Special Project S35A113. 12 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 13 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 14 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 15 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 16 resolution. 17 Section 4. Repealer.
