3 A RESOLUTION TO AUTHORIZE THE MAYOR, CITY CLERK AND
4 CITY MANAGER TO EXECUTE REAL ESTATE CONTRACTS,
5 CONVEY CERTAIN REAL PROPERTY, PERMANENT AND
6 TEMPORARY CONSTRUCTION EASEMENTS LOCATED ALONG THE
7 PROPOSED BROADWAY STREET BRIDGE REPLACEMENT
8 PROJECT TO THE ARKANSAS HIGHWAY AND TRANSPORTATION
9 DEPARTMENT FOR A ROADWAY IMPROVEMENT PROJECT; AND
10 FOR OTHER PURPOSES.

12 WHEREAS, the Arkansas Highway and Transportation Department is undertaking a bridge
13 replacement project along State Highway 70, Broadway Street which will necessitate the acquisition of
14 real property and permanent and temporary construction easements from the City; and,
15 WHEREAS, the Arkansas Highway and Transportation Department has requested a donation of the
16 property and easements needed from the City to accomplish the construction; and,
17 WHEREAS,the City Board of Directors has determined that it is in the best interests of the City and
18 its inhabitants for the City to convey the property needed by the Arkansas State Highway Department for
19 the Broadway Bridge Replacement Project;
20 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. The Mayor and City Clerk are hereby authorized to execute, in a form approved by the
23 City Attorney, any documents required to convey to the Arkansas State Highway Department certain
24 lands located in the Pulaski County,Arkansas,more particularly described as follows:
25 Tract 3: Part of Lot 12, Block 121, Original City of Little Rock, Township 1 North, Range
26 12 West, Pulaski County, Arkansas,more particularly described as follows:
27 BEGINNING at a point being used as the southeast corner of Lot 12 of Block 121
28 which is also on the northerly right-of-way line of Markham Street as established by the Plat
29 of the Original City of Little Rock, Arkansas, recorded as Instrument No. 2010000004; thence
30 North 80° 27' 12" west along said right-of-way line a distance of 35.26 feet to a point on
31 the westerly right-of-way line of U.S. Highway 70 (Broadway Street) as established by AHTD
32 Job 061275; thence North 69° 56' 55" east along said right-of-way line a distance of 40.52

12 of-way Plans for Job No. 061275, and designated as Tract Nos. 3E-1, 4XE-1, 4XE-2 situated in
13 the County of Pulaski, State of Arkansas.
14 This temporary easement as conditioned above shall terminate when the above subject job
15 has been completed by the contractor and accepted by the Arkansas State Highway Commission.
16 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
17 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
18 adjudication shall not affect the remaining portions of the resolution which shall remain in full force
19 and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a
20 part of the resolution.
21 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
22 with the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
