3 AN ORDINANCE TO ABANDON A TWENTY (20)-FOOT WIDE
4 EASEMENT LOCATED WITHIN THE PREVIOUSLY-ABANDONED
5 NORTH/SOUTH ALLEY IN THE BLOCK BOUNDED BY CAPITOL
6 AVENUE, EAST 4TH STREET, RIVER MARKET AVENUE AND ROCK
7 STREET AND LOCATED ADJACENT TO LOTS 1-6, BLOCK 149
8 ORIGINAL CITY AND LOTS 1-6, BLOCK 17 POPE'S ADDITION, IN
9 THE CITY OF LITTLE ROCK, ARKANSAS (G-24-042); AND FOR
10 OTHER PURPOSES.

12 WHEREAS, a request was made to abandon a twenty (20)-foot wide easement located within the
13 previously-abandoned north/south alley in the block bounded by Capitol Avenue, East 4th Street, River
14 Market Avenue and Rock Street, pursuant to the City's general police power authority under Ark. Code
15 Ann. § 14-54-104; and;
16 WHEREAS, the Board has determined that the abandonment of the aforementioned easement will
17 not have an adverse impact on the adjacent property owners or the public welfare and safety;
18 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
19 OF LITTLE ROCK,ARKANSAS:
20 Section 1. The Board of Directors hereby releases, vacates, and abandons the twenty (20)-foot wide
21 easement located adjacent to Lots 1-6, Block 149 Original City and Lots 1-6, Block 17 Pope's Addition,
22 in the City of Little Rock,Arkansas.
23 Section 2. All utilities and Public Works have approved the abandonment; the easement is located
24 entirely within the applicants' property; and there are no utility or drainage facilities in the easement.
25 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
26 records of the recorder of the Circuit Clerk in ex-officio recorder of Pulaski County,Arkansas.
27 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
29 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
30 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
31 of the ordinance.
32 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the s
33 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such , =
