13781 1 RESOLUTION NO. 13,781 2 3 A RESOLUTION TO AUTHORIZE A CONTRACT WITH MCGEORGE 4 CONTRACTING, INC., TO CONSTRUCT NEW CELLS FOR THE 5 CITY'S CLASS 1 AND CLASS 4 LANDFILLS; AND FOR OTHER 6 PURPOSES. 7 8 WHEREAS,the City of Little Rock("City"), which owns a Class 1 and a Class 4 Landfill,and 9 WHEREAS, the City needs to begin construction on new landfill cells as soon as possible to 10 maintain disposal capacity and assure continued compliance with state and federal environmental 11 regulations,and 12 WHEREAS, the City issued Bid No. 13158 for construction of Class I Cell 5 East and Class 4 13 Cell 3,and 14 WHEREAS, McGeorge Contracting, Inc., provided the lowest responsible and responsive bid in 15 the amount of Two Million, Two Hundred Twenty-Eight Thousand, Seven Hundred Thirty and 93/100 16 Dollars($2,228,730.93), Two Million, Twenty-Six Thousand, One Hundred Nineteen and 03/100 Dollars 17 (2,026,119.03),plus 10% contingencies, and 18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 19 CITY OF LITTLE ROCK,ARKANSAS: 20 Section 1. The Board of Directors hereby authorizes the City Manager to enter into an 21 agreement, in a form acceptable to the City Attorney, with McGeorge Contracting, Inc., provided the 22 lowest responsible and responsive bid in the amount of Two Million, Two Hundred Twenty-Eight 23 Thousand, Seven Hundred Thirty and 93/100 Dollars ($2,228,730.93), Two Million, Twenty-Six 24 Thousand, One Hundred Nineteen and 03/100 Dollars (2,026,119.03), plus 10% contingencies, to 25 construct the Class 1 Cell 5 East and Class 4 Cell 3 of the Little Rock Landfill. 26 Section 2. Funds for the payment of this contract are available from Reserve Funds of the City 27 Solid Waste Enterprise Fund. 28 Section 3. Severabiliry. In the event any title, section, paragraph, item, sentence, clause, phrase, 29 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 30 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 31 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 32 resolution. 33 Section 4. Repealer.
