Code 12 Ann. § 14-54-104; and 13 WHEREAS, the Board has determined that the abandonment of the aforementioned easement will 14 not have an adverse impact on the adjacent property owners or the public welfare and safety; 15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 16 OF LITTLE ROCK,ARKANSAS: 17 Section 1. The Board of Directors hereby releases, vacates, and abandons the fifteen (15)-foot wide 18 easement located along the rear (north) property line of Lot 2, Block 42, Chenal Valley Addition to the 19 City of Little Rock, Arkansas; less and except the east five(5)feet thereof. 20 Section 2. All utilities and Public Works have approved the abandonment; the easement is located 21 entirely within the applicants' property; and there are no utility or drainage facilities in the easement. 22 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate 23 records of the recorder of the Circuit Clerk in Ex-Officio recorder of Pulaski County, Arkansas. 24 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 25 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 26 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 27 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part 28 of the ordinance. 29 Section 5. Repealer.
