9 WHEREAS, a request has been made that the Board of Directors vacate and abandon seventeen (17)
10 street and alley rights-of-way located north of the Clinton National Airport, generally located south of
11 East 6' Street and east of Apperson Street, pursuant to the City's general police power authority under
12 Ark. Code Ann. § 14-54-104; and,
13 WHEREAS, the Board has determined that the abandonment of the aforementioned easement will
14 not have an adverse impact on the adjacent property owners or the public welfare and safety;
15 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK,ARKANSAS:
17 Section 1. The Board of Directors hereby releases, vacates, and abandons seventeen (17) street and
18 alley rights-of-way located north of the Clinton National Airport, generally located south of East 6" Street
19 and east of Apperson Street, in the City of Little Rock,Arkansas.
20 Section 2. The City specifically reserves any required public utility easements.
21 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
22 records of the recorder of the Circuit Clerk in Ex-Officio recorder of Pulaski County, Arkansas.
23 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
24 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
25 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
26 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
27 of the ordinance.
28 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
29 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

Retain or provide 20' easement for the following ROW abandonment locations:
• Dedicated Rumbough Street ROW from the East ROW of Townsend Street to the West ROW of
Harrington Street
• Dedicated East 7th Street ROW from the East ROW of Townsend Street to the West ROW of
Harrington Street
• Dedicated East 8th Street ROW from the East ROW of Townsend Street to the West ROW of
Harrington Street
• Dedicated Harrington Street ROW from the North ROW of Rumbough Street to the North ROW
of East 10th Street
Central Arkansas Water—no objection to ROW Abandonment. Retain 10' easement (5' either side of
water main) along East 8th Street, East 9th Street, East 11th Street, East 12th Street, Townsend Street, and
part of Harrington Street. Retain easement along 2' water main along Townsend Street, unless the Airport
Commission agrees that CAW can abandon.
Centeraoint Energy — no objection to ROW Abandonment if easements are retained or granted as
follows:
Retain 20' easement for the following ROW abandonment locations:
• East 9th Street ROW from the East ROW of Apperson Street to the West ROW of Townsend St.
• East 10th Street ROW from the East ROW of Apperson Street to the West ROW of Townsend St.
• Townsend Street ROW from the South ROW of East 8th Street to the North ROW of East 11th St.
• Townsend Street ROW from the South ROW of 11th Street to the South ROW of East 12th St.
Enterzy — no objection to ROW Abandonment. If City agrees, Entergy can remove lights on various
streets. Primary facilities on Townsend St. between 11th and 12 Streets and along 12th Street will need to
remain in place to serve existing customers.
Little Rock Wastewater Utility — no objection to ROW Abandonment if easements are retained or
granted as follows:
Retain/grant the following easements:
• 20' easement along East 7th Street ROW from the East ROW of Townsend to the West ROW of
Harrington Street
• 10' easement along East 10th Street ROW from the East ROW of Apperson Street to the West
ROW of Harrington Street
• 10' easement along East 12th Street ROW from the East ROW of Apperson Street to the West
ROW of Townsend Street
• 20' easement along Townsend Street ROW from the South ROW of East 8th Street to the North
ROW of East 11th Street
