8 WHEREAS, a request has been made that the Board of Directors vacate and abandon twenty-four
9 (24)street and alley rights-of-way located north of the Clinton National Airport,along the north and south
10 sides of East 9th Street, pursuant to the City's general police power authority under Ark. Code Ann. § 14-
11 54-104;and,
12 WHEREAS, the Board has determined that the abandonment of the aforementioned easement will
13 not have an adverse impact on the adjacent property owners or the public welfare and safety;
14 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK,ARKANSAS:
16 Section 1. The Board of Directors hereby releases, vacates, and abandons twenty-four(24) street and
17 alley rights-of-way located north of the Clinton National Airport, along the north and south sides of East
18 9th Street, in the City of Little Rock, Arkansas.
19 Section 2. The City specifically reserves any required public utility easements.
20 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
21 records of the recorder of the Circuit Clerk in Ex-Officio recorder of Pulaski County,Arkansas.
22 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
23 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
24 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
25 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
26 of the ordinance.
27 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
28 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

AT&T—no objection to ROW Abandonment if easements are retained or granted as follows:
Retain or provide 20' Easement for the following ROW abandonment location:
• 20' alley within Block 16, Industrial Park Addition
Central Arkansas Water—no objection to ROW Abandonment. Retain 10'easement(5' either side of
water main)for water mains along East 10th Street and Leonard Street. Retain easement along 2' water
main along Selma Street, Kirspel Street, Concord Street,Crosby Street,Ventura Street, Bedford Street,
Maxwell Street,and Carson Street.
Centernoint Energy — no objection to ROW Abandonment if easements are retained or granted as
follows:
Retain 20' easement for the following ROW abandonment locations:
• Kirspel Street ROW between Blocks 15 and 16
• East 10th Street ROW from the West ROW of Kirspel Street to the West ROW of Conner Street
• Leonard Street ROW between Blocks 16 and 26
• Concord Street ROW between Blocks 26 and 27
Entergy—no objection to ROW Abandonment. Primary lines and street lights north of 9th Street appear
to be idle and can be removed in conjunction with any removal of CATV or telephone circuits which may
be attached to the poles. If City agrees, street lights south of 9th Street can be removed. A number of
primary distribution lines feeding along and south of 9th Street need to remain,or arrangements need to be
made to relocate under Entergy's relocation policy and per customer's request.
Little Rock Wastewater Utility — no objection to ROW abandonment if easements are retained or
granted as follows:
Retain/grant the following easements:
• 10' easement Kirspel Street ROW between Blocks 15 and 16
• 10' easement through 20' alley within Block 26
