3 AN ORDINANCE TO AMEND CHAPTER 8 OF THE 1988 LITTLE ROCK
4 CODE OF ORDINANCES AND ORDINANCE NO. 19,638; TO PROVIDE
5 FOR THE ADOPTION BY REFERENCE OF THE 2012
6 INTERNATIONAL EXISTING BUILDING CODE; AND FOR OTHER
7 PURPOSES.

9 WHEREAS, Little Rock, Ark. Rev. Code 8-2 (4) adopts by reference the 2012 Edition of the
10 International Existing Building Code and Appendix "A", "B" and "C", and Appendices Section I, II, III,
11 IV and V published by the International Code Council, Falls Church, Virginia; and,
12 WHEREAS, the City has complied with Ark. Code Ann. X 14-55-207 (1987) by publishing a notice
13 of intent to adopt these technical codes by reference in a paper of general circulation within the
14 municipality and three (3) copies of Codes have been available for inspection in the City Clerk's Office
15 by the public prior to their adoption; and,
16 WHEREAS,this ordinance amendment is necessary to update the City Code and authorize the use of
17 the 2012 Edition within the City;
18 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
19 OF LITTLE ROCK,ARKANSAS:
20 Section 1. Section 8-2 (4) of Little Rock, Arkansas Revised Code is hereby amended to read as
21 follows:
22 Section 8-2 Codes Adopted.
23 (A)The following publications are adopted by reference:
24 (4) The 2012 International Existing Building Code and Appendix "A", "B" and
25 "C", and Appendices Section I, II, III, IV and V
26 (B)Notwithstanding the provisions of Sections (A) above,the City, consistent with other
27 provisions of state law, shall set the job qualification for its employees. No job
28 qualifications contained in the International Existing Building Code are adopted in
29 any form whatsoever.
30 Section 2. All ordinances or parts of ordinances in conflict with this provision are hereby repealed to
31 the extent of the conflict.
32 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
33 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or

1 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
2 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
3 ordinance.
4 Section 4. Code Application. Permits obtained prior to the effective date of this ordinance will be
5 enforced under the previous adopted code till final disposition of the permit.
6 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
7 the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
8 Section 6. Effective date of this ordinance shall be January 1, 2014.
