20776 1 ORDINANCE NO. 20,776 2 3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF 4 COMPETITIVE BIDS AND TO AUTHORIZE AN AGREEMENT 5 BETWEEN THE CITY OF LITTLE ROCK, ARKANSAS, AND METRO 6 LITTLE ROCK ALLIANCE FOR THE PURPOSE OF ECONOMIC 7 DEVELOPMENT ADVERTISEMENT WITHIN A CENTRAL ARKANSAS 8 AREA; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. 9 10 WHEREAS, the City of Little Rock, Arkansas, benefits from economic development opportunities 11 both within the corporate limits of the City,and from such programs developed within the central Arkansas 12 area, because this combined area provides significant education, transportation, and work force 13 opportunities; and, 14 WHEREAS, working through the Little Rock Regional Chamber of Commerce a program has been 15 started called the Metro Little Rock Alliance which markets a large area within Central Arkansas for various 16 economic development opportunities even though an actual plant or company may not be located within 17 the corporate limits of any particular member; and, 18 WHEREAS,this is a unique organization that makes it impractical and unfeasible for the City to elect 19 to participate in such a program through formal competitive bidding; and, 20 WHEREAS, pursuant to Section 6 of Little Rock, Ark., Ordinance No. 20,671 (December 18, 2012), 21 the Board of Directors budgeted for participation in the Metro Little Rock Alliance; 22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 23 OF LITTLE ROCK,ARKANSAS: 24 Section 1. The Board of Directors authorizes the Mayor,and any other necessary officials,to execute 25 an agreement in substantially the form as that attached as Exhibit A to this ordinance,with the Metro Little 26 Rock Alliance to provide economic development marketing services for the City and other participating 27 local governments. 28 Section 2. Because of the unique nature of the Metro Little Rock Alliance, as it is operated in 29 conjunction with the Little Rock Regional Chamber of Commerce,the City finds that it is impractical and 30 unfeasible to purchase some services through formal competitive bidding and, therefore, waives the 31 requirement of such bidding. 32 Section 3. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 33 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or [Page 1 of 4I 1 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 2 ordinance, as if such invalid or unconstitutional provision were not originally a part of this ordinance. 3 Section 4. Repealer.All ordinances,resolutions, bylaws, and other matters inconsistent with this 4 ordinance are hereby repealed to the extent of such inconsistency. 5 Section S. Emergency. Carpenter, City Attornn 20 // 21 // 22 // 23 // 24 // 25 // 26 // 27 // 28 // 29 // 30 // 31 // 32 // 33 // 34 // 35 // [Page 2 of 4] 1 EXHIBIT A 2 METRO LITTLE ROCK ALLIANCE 3 CONTRACT FOR MARKETING SERVICES 4 This is a contract entered into by the Little Rock Regional Chamber of Commerce dba Metro Little Rock 5 Alliance(hereinafter referred to as"MLRA")and the City of Little Rock(hereinafter referred to as"Little 6 Rock"on August 7, 2013. 7 MLRA's place of business is 1 Chamber Plaza,Little Rock,AR 72201 and Little Rock's place of business 8 is 500 West Markham, Little Rock,AR 72201. 9 Little Rock hereby engages MLRA to provide marketing services described herein under"Scope and Man- 10 ner of Services."MLRA hereby agrees to provide Little Rock with such services in exchange for$100,000 11 payment of its annual dues as a contributing member of MLRA as described herein under "Payment for 12 Services Rendered." 13 Scope and Manner of Services 14 MLRA operates with a vision for Central Arkansas to become recognized as the premier location for new 15 and expanding business within the mid-south. The mission to accomplish its vision is to cultivate regional 16 growth and prosperity throughout the area by marketing the region's strengths and advantages to prospec- 17 tive companies and site location consultants for the purpose of attracting investment and creating jobs. 18 Services to be rendered to Little Rock by MLRA may include but are not limited to: (1) marketing of the 19 region at a national level to site location consultants; (2) marketing of the region at a national level to 20 targeted industry;(3)regional website maintenance and enhancement to market the regional nationally and 21 internationally; (4) marketing the region's available products (land, buildings, labor, etc.) nationally; and 22 (5)providing project management of new location prospects. 23 Payment for Services Rendered 24 Little Rock shall pay MLRA for marketing services rendered according to the "allocated dues schedule" 25 determined by the MLRA Executive Committee. The"allocated dues schedule" stipulates that Little Rock 26 will pay$100,000.
