3 AN ORDINANCE TO APPROVE A PLANNED ZONING
4 DEVELOPMENT AND ESTABLISH A PLANNED COMMERCIAL
5 DISTRICT TITLED 7TH AND WOODROW SHORT-FORM PCD (Z-7895-
6 B), AND TO REVOKE THE PCD ZONING FOR A PORTION OF THE
7 PROPERTY, LOCATED AT 712 — 724 APPIAN WAY, LITTLE ROCK,
8 ARKANSAS; TO AMEND THE OFFICIAL ZONING MAP OF THE CITY
9 OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

11 WHEREAS, Ordinance No. 19,820 was passed on September 18, 2007, establishing a Planned
12 Zoning District, titled 7th and Woodrow Short-Form PCD, Planned Commercial Development, (Z-7895-
13 B), located at 712—724 Appian Way; and,
14 WHEREAS, the applicant has requested the rezoning of a portion of the property from PCD to
15 Revised PCD and the revocation of the PCD zoning for a portion of the property;
16 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS:
18 Section 1. That the Planned Zoning Development titled 7th and Woodrow Short-Form PCD is hereby
19 revoked for the following described property and the property is hereby zoned R-2, Single-Family
20 District:
21 Lots 2-6, 7-10 and 14-16 Block 2 Ferndale Addition to the City of Little Rock, Pulaski
22 County,Arkansas.
23 Section 2. That the zoning classification of the following described property be changed from PCD
24 to Revised PCD:
25 Lots 14-17 Block 12 of the Ferndale Addition to the City of Little Rock,Arkansas.
26 Section 3. That the approval of 7th and Woodrow Short-Form PCD (Z-7895-B), located at 712—724
27 Appian Way, is subject to compliance with the following additional conditions:
28 • That the preliminary site development plan/plat be approved as submitted, including all
29 staff comments and conditions as outlined in the Planning Commission Agenda Staff
30 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis
31 in paragraph H and subject to additional conditions imposed at the Plannin4,Gommi }on

1 Section 4. That the preliminary site development plan/plat be approved as recommended by the
2 Little Rock Planning Commission.
3 Section 5. That the change in zoning classification contemplated for 7th and Woodrow Short-Form
4 PCD (Z-7895-B), located at 712 — 724 Appian Way, is conditioned upon obtaining a final plan approval
5 within the time specified by Chapter 36, Article VII, Section 36-454 (e)of the Code of Ordinances.
6 Section 6. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
7 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
8 necessary to affect and designate the change provided for in Sections 1 and 2 hereof.
9 Section 7. That this ordinance shall not take effect and be in full force until the final approval of the
10 plan.
11 Section 8. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
12 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
13 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
14 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
15 ordinance.
16 Section 9. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
17 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
