A RESOLUTION AUTHORIZING THE MAYOR
TO EXECUTE A "COOPERATIVE AGREEMENT"
ON BEHALF OF THE CITY WITH PULASKI
COUNTY WHEREBY SANITATION COLLECTION
VEHICLES WILL BE LOANED TO PULASKI
COUNTY UNTIL JULY 1 , 1981 , WHEN
SANITATION SERVICES WILL BE PROVIDED
TO THE NEWLY ANNEXED "SOUTHWEST ISLAND" ;
AND FOR OTHER PURPOSES.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1 . The Mayor is hereby authorized to enter
into a "cooperative agreement, " a copy of which is attached
hereto as Exhibit A, on behalf of the City with Pulaski
County whereby sanitation collection vehicles will be loaned
to Pulaski County until July 1 , 1981 , and wherein the City
agrees to provide sanitation collection services to the
newly annexed "Southwest Island" as shown on the map
attached to Exhibit A.
SECTION 2. This Resolution shall be in full force and
effect from and after its adoption and approval .

COOPERATIVE AGREEMENT
This COOPERATIVE AGREEMENT made and entered into by
and between the City of Little Rock, Arkansas , a municipal
corporation situated in Pulaski County, Arkansas , hereinafter
referred to as "City", and Pulaski County, a county corporation
situated in Pulaski County, Arkansas , hereinafter referred
to as "County" ;
WITNESSETH:
WHEREAS , a portion of Pulaski County, Arkansas centered
around the intersection of Mabelvale Cutoff and Chicot Roads ,
known as "Southwest Island" has been annexed into the City of
Little Rock by Ordinance No. passed December 16 , 1980
by action of the City of Little Rock Board of Directors . Said
annexed territory is more particularly described as follows,
to-wit :
See Exhibit "A" attached hereto and
made a part hereof as if set out word
for word.
WHEREAS , the City desires to provide sanitation
collection services to said annexed territory, but will be
unable to do so until July 1 , 1981 because of operational
problems ; and
WHEREAS , the County is willing to provide such sani-
tation collection services to said annexed territory until
the City is able to take over the services on July 1 , 1981;
WHEREAS , the City and the County desire to enter into
this COOPERATIVE AGREEMENT pursuant to the provisions of Ark.
Stat. Ann. §14-901 et seq. to provide for sanitation collection
services to said annexed territory.
NOW, THEREFORE for and in consideration of the pro-
mises and for other good and valuable consideration, the
receipt of which is hereby acknowledged , the City and the
County hereby contract and agree cooperatively as follows ,
to-wit :
1) The County agrees to provide sanitation collection
services to said annexed territory July until Jul 1 , 1981.
2) The City agrees to transfer the use and possession
of two of its sanitation collection vehicles to the County
until July 1, 1981 at which time the County agrees to return
said sanitation collection vehicles to the City in the same
condition as they were when transferred to the County.
3) The County agrees , at its own expense, to provide
all maintenance and repairs for said sanitation collection
vehicles while same are in the possession of the County.
4) The County agrees that should it fail to return
said santitation collection vehicles to the City as provided
herein then the City shall have the right , in addition to all
of its other legal and equitable rights and remedies , to
enter County property and take repossession of said sanitation
collection vehicles ; and the County further agrees to reim-
burse the City of all its costs and expenses attendant to
any such failure to return said sanitation collection vehicles
as provided herein.
5) The County agrees that it shall bear the sole
responsibility for any damages and/or causes of action arising
out of its providing the sanitation collection services pro-
vided for herein; and that the County shall hold the City
harmless and/or indemnify the City for any damages , costs or
expenses the City may suffer as a result of the County pro-
viding said sanitation collection services .
6) The City agrees that it will provide sanitation
collection services to said annexed territory on and after
July 1 , 1981.
