3 AN ORDINANCE TO ABANDON A NORTH/SOUTH ALLEY RIGHT-
4 OF-WAY AND EASEMENTS LOCATED BETWEEN BATTERY AND
5 WOLFE STREETS, SOUTH OF 12TH STREET, BLOCK 5 CENTENNIAL
6 ADDITION, IN THE CITY OF LITTLE ROCK, ARKANSAS (G-23-437);
7 AND FOR OTHER PURPOSES.

9 WHEREAS, a request was made to abandon approximately 330 linear-feet of a twenty (20)-foot
10 wide alley right-of-way, along with a portion of the easements located south of 12th Street between
11 Battery and Wolfe Streets, Block 5 Centennial Addition, pursuant to the City's general police power
12 authority under Ark. Code Ann. § 14-54-104; and
13 WHEREAS, the Board has determined that the abandonment of the aforementioned alley right-of-
14 way and easements will not have an adverse impact on the adjacent property owners or the public welfare
15 and safety;
16 NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS:
18 Section 1. The Board of Directors hereby releases, vacates, and abandons the twenty (20)-foot wide
19 alley right of way located adjacent to Lots 1-12, Block 5, Centennial Addition to the City of Little Rock,
20 Arkansas, and easements located in the twenty (20)-foot wide alley right of way located adjacent to Lots
21 1-5 and 8-12, Block 5, Centennial Addition to the City of Little Rock, Arkansas.
22 Section 2. All utility companies and the Little Rock Public Works Department concur with
23 abandonment of the right of way and the abandonment of the easement adjacent to Lots 1-5 and 8-12 and
24 maintaining the easement rights adjacent to Lots 6 and 7.
25 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
26 records of the recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County,Arkansas.
27 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
29 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
30 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
