A RESOLUTION CALLING A SPECIAL REFERENDUM
ELECTION REFERRING CITY OF LITTLE ROCK
ORDINANCE NO. 13,558, PASSED DECEMEKR 27,
1978, TO A VOTE OF THE PEOPTE; AND FOR OTHER
PURPOSES .
14HEREAS, on the 27th day of December 1978, the Board of Directors
of the City of Little Rock, Arkansas adopted Ordinance No. 13,558
providing for the construction and operation of a cable television
system in Little Rock, Arkansas and awarding a franchise for such
operation to Midwest-American Cable Company, an Arkansas corporation;
and
UHEREAS, petitions calling for a referendum on said Ordinance
have been filed under Amendment 7 to the Constitution of the State of
Arkansas, and the City Clerk reported to the Board of Directors that
a sufficient number of valid signatures to authorize said referendum
election under Amendment 7 to the Constitution of the State of Arkansas
have been filed;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARRAS :
SECTION 1. That a special election be, and the same is hereby,
called to be held in the City of Little Rock, Arkansas on the 22nd
day of January, 1980, at which election there will be submitted to the
people of the City of Little Rock, Arkansas the question of approving
or disapproving Ordinance No. 13,558.
SECTION 2. That the measure should appear on the ballot in
substantially the same form as it appeared on the Petitions, to-wit:

"AN ORDINANCE TO GRANT TO MIDWEST AMERICAN CABT E
COMPANY THE FRANCHISE, RIGHT AND PRIVILEGE TO
CONSTRUCT, ERECT, OPERATE AND MAINTAIN IN, UPON,
ALONG, ACROSS , ABOVE, OVER AND UNDER THE STREETS ,
ALLEYS , PUBLIC WAYS AND PUBLIC PLACES NOW LAID OUT
OR DEDICATED, AND ALL EXTENSIONS THEREOF, AND
ADDITION THERETO IN THE CITY, POLES , WIRES ,
CABLES , UNDERGROUND CONDUITS , MANHOLES, AND OTHER
CONDUCTORS , AND FIXTURES NECESSARY FOR THE MAINTENANCE
AND OPERATION IN THE CITY OF A CARTE TELEVISION
SYSTEM FOR THE INTERCEPTION, SALE AND DISTRIBUTION
OF TELEVISION AND RADIO SIGNALS ."

SECTION 3. That the election shall be held and conducted and the
vote canvassed and the results declared under the law and in the manner
now or hereafter provided for municipal elections, so far as the same
may be applicable, and notice shall be given of such election by an
advertisement published in a newspaper having a bona fide circulation
in Little Rock, Arkansas with publication to be not less than ten (10)
days prior to the date of the election, and only qualified electors of
the City of Little Rock, Arkansas shall have the right to vote.
SECTION 4. That a certified copy of this Resolution shall be
given to the Pulaski County Board of Election Commissioners, so that
the necessary election officials and supplies may be provided.
SECTION 5. This Resolution shall be in full force and effect
from and after its adoption.
