13754 1 RESOLUTION NO. 13,754 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO APPLY 4 TO THE ARKANSAS DEPARTMENT OF PARKS AND TOURISM FOR 5 ASSISTANCE TO DEVELOP RECREATIONAL FACILITIES AT THE 6 LITTLE ROCK ZOO, LOCATED IN WAR MEMORIAL PARK AT 1 ZOO 7 DRIVE IN LITTLE ROCK, ARKANSAS, FOR THE CITY OF LITTLE 8 ROCK; AND FOR OTHER PURPOSES. 9 10 WHEREAS,the City of Little Rock, Arkansas, seeks to improve the recreation facilities at the Little 11 Rock Zoo and wishes to seek grant funding assistance; and, 12 WHEREAS, a public meeting was held and the public registered a strong desire to create interactive 13 exhibits at the Zoo for children, particularly those with disabilities; and, 14 WHEREAS, as a result of receiving the public input, the Zoo desires to construct an Arkansas Farm 15 Exhibit with several accessible contact yards where the public can touch and interact with animals and 16 learn about farming; and 17 WHEREAS, in order to obtain the funds necessary to improve the Zoo for such a recreation project, 18 which is estimated to cost Five Hundred Ninety Thousand Dollars($590,000.00), it is necessary to obtain 19 a 50/50 Matching Grant from the Arkansas Department of Parks and Tourism's Outdoor Recreation Grant 20 Program, which could provide as much as Two Hundred Fifty Thousand Dollars ($250,000.00) of the 21 total cost; and, 22 WHEREAS, this governing body understands the grantee and grantor will enter into a binding 23 agreement which obligates both parties to policies and procedures contained in the Land and Water 24 Conservation Fund Grants Manual including, but not limited to the following: the park area defined by 25 the project boundary map, submitted in the application, must remain in outdoor recreation use in 26 perpetuity, regardless if the property is bought or developed with matching grant funds and; all present 27 and future overhead utility lines within the project boundary must be routed away or placed underground 28 and; the project area must remain open and available for use by the public at all reasonable times of the 29 day and year; facilities can be reserved for special events, league play, etc., but cannot be reserved, leased 30 or assigned for exclusive use, and; the project area must be kept clean, maintained, and operated in a safe 31 and healthful manner; and, 32 WHEREAS, the Board of Directors is well aware and apprised of the above-mentioned project and 33 will provide the local portion of the development cost of the entire project; [Page 1 of 2] 1 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 2 OF LITTLE ROCK,ARKANSAS: 3 Section 1. The City Manager is hereby authorized to make application to the Arkansas Department 4 of Parks and Tourism for assistance to develop Arkansas Farm Exhibit recreational facilities in the Little 5 Rock Zoo, which is in War Memorial Park and located at 1 Zoo Drive in Little Rock, Arkansas, for the 6 City of Little Rock; therefore such application shall be submitted as expediently as possible. 7 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 8 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 9 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 10 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 11 resolution. • 12 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 13 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency. 14 Section 4.
