13743 1 RESOLUTION NO. 13,743 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO 4 EXECUTE A PUBLIC AGENCY SERVICES AGREEMENT TO 5 PROVIDE EMERGENCY RESPONSE AND FIRE SUPPRESSION 6 SERVICES FOR NATIONAL PARK SERVICE PROPERTIES WITHIN 7 THE CENTRAL HIGH SCHOOL NATIONAL HISTORIC SITE; AND 8 FOR OTHER PURPOSES. 9 10 WHEREAS, Arkansas Code Ann. § 25-20-108(a) (West Supp. 2011) authorizes one (1) or more 11 public agencies to contract with any one (1) or more other public agencies to perform any governmental 12 service, activity or undertaking which each of the public agencies entering into the contract is authorized 13 by law to perform alone; and 14 WHEREAS, the National Park Service has authority over two (2) Federal properties in the Central 15 High School National Historic Site: the visitor center located at 2120 Daisy Gaston Bates Drive; and the 16 Historic Mobile Station located across the street at 2125 Daisy Gaston Bates Drive; and, 17 WHEREAS, because the National Park Service does not have a fire engine or other emergency 18 firefighting apparatus for these properties, the agency requested that the Little Rock Fire Department 19 provide emergency response and fire suppression services pursuant to 42 U.S.C.A. §1856a, which 20 authorizes Federal agencies to enter reciprocal agreements for mutual aid in furnishing fire protection for 21 their properties; and 22 WHEREAS,the Little Rock Fire Department is able to provide qualified personnel, fire suppression 23 equipment, and rescue equipment to provide emergency response and fire suppression services within the 24 Central High School National Historic Site. 25 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 26 OF LITTLE ROCK,ARKANSAS: 27 Section 1. Pursuant to the authority set forth in Arkansas Code Ann. § 25-20-108 (West Supp. 28 2011), the City Manager is authorized to execute a public agency service agreement with the National 29 Park Service, in a form to be approved by the City Attorney, to provide emergency response and fire 30 suppression services for National Park Service properties located within the Central High School National 31 Historic Site, for a term of five (5) years with option to renew the term upon written agreement of the 32 parties. In the event any title, section, paragraph, item, sentence, clause, phrase, or 2 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 3 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 5 resolution. 6 Section 3. Repealer.
