A RESOLUTION URGING THE ARKANSAS DEPARTMENT OF
POLLUTION CONTROL AND ECOLOGY TO APPEAL THE
DECISION OF THE CIRCUIT COURT OF PULASKI COUNTY
IN THE DECISION OVER THE PERMIT FOR THE LAND-
FILL ON THE WORTH JAMES PROPERTY; AND FOR OTHER
PURPOSES
WHEREAS , a proposed solid waste disposal facility to be
operated in the vicinity of the Mabelvale Pike area on a thirty
acre tract which is part of 253 acres owned by Worth James would
produce an undue burden upon the population of that area in the
form of vector problems, stray animals , heavy littering, and
other related sanitary landfill problems;and
WHEREAS, the Circuit Court of Pulaski County reversed the
decision of the Arkansas Department of Pollution Control and
Ecology and ordered the Department to issue a permit for the
operation of a solid waste disposal facility on that site; and
WHEREAS , the Arkansas Department of Pollution Control and
Ecology has filed a notice of appeal to the Supreme Court of
Arkansas;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS .
SECTION 1 . The Board of Directors of the City of Little
Rock, Arkansas hereby urges the Arkansas Department of Pollution
Control and Ecology to continue the appeal process for the purpose
of resolving the issue in the Supreme Court of Arkansas of whether
a landfill should be built in the Mabelvale Pike Area on the
Worth James land.
SECTION 2 . This Resolution shall be in full force and
effect from and after its adoption.
