5591 RESOLUTION NO 5,591 A RESOLUTION GRANTING A FRANCHISE TO STEPHENS , INCORPORATED TO CONSTRUCT A SECOND FLOOR LEVEL CORRIDOR BETWEEN THE STEPHENS BUILDING LOCATED AT EAST CAPITOL AND MAIN STREETS AND THE BUILDING IMMEDIATELY WEST ACROSS THE PUBLIC OWNED ALLEY; AND FOR OTHER PURPOSES BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1 . Stephens , Incorporated of Little Rock is hereby granted a franchise to construct a second floor level corridor between the Stephens Building, East Capitol and Main Streets and the building immediately west across the public owned alley . The description of said easement is as follows : An 112 ' easement beginning at a point 22 . 7 ' north of the southeast corner of Lot 5 , Block 5 , Little Rock, Pulaski County, Arkansas , which is the intersection of the east line of said Lot 5 and the centerline of said 112 ' easement; thence southeasterly along said centerline 21. 3 ' to a point on the west line of Lot 8, Block 5, said point being 15 . 3 ' north of the southwest corner of said Lot 8, all in Little Rock, Pulaski County, Arkansas . SECTION 2 . This easement franchise is granted subject to the following conditions : a) Stephens, Incorporated will bear the expense of relocating certain cables presently attached to the rear of the building involved which are owned by Southwestern Bell Telephone Company b) Stephens, Incorporated shall obtain a conditional use permit for the air space involved. c) If at some time in the future it becomes necessary for the City to utilize said right-of-way involved for any purposes deemed necessary, then upon sixty (60) days written notice by the City, said corridor shall be removed and the property restored to its condition at the time of the granting of this franchise at the sole expense of the owner.
