3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A VOLUME DISCOUNT AGREEMENT WITH WASTE
5 CORPORATION OF ARKANSAS FOR DISPOSAL OF CLASS I AND
6 CLASS IV SOLID WASTE; AND FOR OTHER PURPOSES.

8 WHEREAS, the City of Little Rock("City"), which owns Class I and Class IV landfills,and
9 WHEREAS, a volume discount will enable the City to bring in additional revenues through
10 agreements with high-volume landfill customers and
11 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
12 CITY OF LITTLE ROCK,ARKANSAS:
13 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a volume
14 discount agreement, in a form acceptable to the City Attorney, with Waste Corporation of Arkansas for
15 the disposal in the City's landfill Class I and Class IV solid waste. In exchange for the disposal of a
16 minimum monthly tonnage of 1,200 tons per month, the authorized charge is no less than $24.00 per ton,
17 plus State and District fees, which are currently $2.80 per ton. The volume discount rate is subject to
18 change in the event the City enacts rate increases or if there are increases in applicable State, District, or
19 other fees. The volume discount rate will be reviewed annually for continuation and is subject to change
20 at any time should there be increases in the City rate or other applicable fees as stated above.
21 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
22 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
23 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
24 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
25 resolution.
26 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same,that are inconsistent
27 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
