13737 1 RESOLUTION NO. 13,737 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO AN AGREEMENT WITH THE ARKANSAS STATE HIGHWAY 5 AND TRANSPORTATION DEPARTMENT TO INCORPORATE 6 LIGHTING IN THE PLANS FOR JOB 061277, UNION PACIFIC 7 RAILROAD STRUCTURE & APPROACHES (ROOSEVELT ROAD); 8 AND FOR OTHER PURPOSES. 9 10 WHEREAS, the City desires to install lighting on the new Roosevelt Road (Highway 70) Bridge; 11 and, 12 WHEREAS, the City is responsible for 100% of the cost to install the lighting as well as all costs 13 associated with future operations and maintenance; and, 14 WHEREAS, the Arkansas State Highway and Transportation Department (AHTD) is willing to 15 incorporate the City's lighting plans into the bridge replacement design plans; and, 16 WHEREAS,AHTD will work with the City to ensure that the City's lighting plans comply with the 17 American Association of State Highway and Transportation Officials (AASHTO) design criteria for 18 lighting; 19 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 20 OF LITTLE ROCK,ARKANSAS THAT: 21 Section 1. The City Manager is hereby authorized to execute an agreement with the Arkansas State 22 Highway and Transportation Department (AHTD) to include lighting on the Roosevelt Road (Highway 23 70)Bridge. 24 Section 2. The City pledges its full support and hereby requests that the AHTD initiate action to 25 include lighting in the project. 26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 28 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 30 resolution. 31 Section 4. Repealer.All laws, ordinances, resolutions, or parts of the same,that are inconsistent with 32 the provisions of this resolution,are hereby repealed to the extent of such inconsistency. 33 Section 5. This resolution will be in full force and effect from and after the date of its adoption.
