13723 1 RESOLUTION NO. 13,723 2 3 A RESOLUTION TO ACCEPT THE DONATION OF PROPERTY NEAR 4 CONNER PARK TO THE CITY OF LITTLE ROCK, ARKANSAS, AND 5 TO AUTHORIZE THE MAYOR TO EXECUTE ALL DOCUMENTS 6 REQUIRED TO ACCEPT TITLE TO THE PROPERTY; AND FOR 7 OTHER PURPOSES. 8 9 WHEREAS, Conner Park is located south of River Mountain Park and provides an opportunity to 10 connect trail users to River Mountain Park and Two Rivers Park, as well as the Arkansas River Trail; and 11 WHEREAS, the Kochtitzky Family has indicated its desire to donate 1.22 acres to the City of Little 12 Rock for the purposes of improving trail access to and from Conner Park and River Mountain Park; and, 13 WHEREAS, the City wishes to accept the property in order to continue to build upon recent 14 improvements made possible by 2009 Bond Refinancing and Boy Scout Volunteer Projects; and, 15 WHEREAS, State Law requires that the City accept the property by a resolution adopted by the 16 Board of Directors; 17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK,ARKANSAS: 19 Section 1. The Board of Directors hereby accepts the proposed donation of 1.22 acres near Conner 20 Park and authorizes the Mayor to execute any and all documentation required to accept title to the 21 property. 22 Section 2. The property shall be used for a public purpose, specifically for improving trail access to 23 and from Conner Park and River Mountain Park. 24 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 25 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 26 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 27 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 28 ordinance. 29 Section 4.Repealer.
