RESOLUTION AUTHORIZING THE EXECUTION
OF A COOPERATION AGREEMENT BY AND
BETWEEN THE HOUSING AUTHORITY OF THE
CITY OF LITTLE ROCK, ARKANSAS, AND THE
CITY OF LITTLE ROCK, ARKANSAS, FOR THE
CENTRAL LITTLE ROCK URBAN RENEWAL PRO-
JECT, ARK R-12
WHEREAS, the Housing Authority of the City of Little Rock, Arkansas,
hereinafter called "Authority, " and the City of Little Rock, Arkansas,
hereinafter called "City, " are desirous of entering into a Cooperation
Agreement in connection with the execution of the Central Little Rock
Urban Renewal Project, ARK R-12; and
WHEREAS, it is desirous to combine the High Street Urban Renewal
Project, ARK R-6, hereinafter referred to as "Phase II, with the Central
Little Rock Urban Renewal Project, ARK R-12, hereinafter referred to
as Phase I, and designate it as Central Little Rock Urban Renewal Project,
ARK R-12; and
WHEREAS, it is desirous to cancel all previous Cooperation Agreements
between the Authority and the City of Little Rock, Arkansas for both Phases
I and II, and to replace them by this combined single superseding Coopera-
tion Agreement; and
WHEREAS, an amendatory application for Loan and Grant, will be
submitted to the Department of Housing and Urban Development for approval;
and
WHEREAS, said Amendatory Application reflects a change in the gross
project cost, net project cost and the two-thirds share of net project costs
as set out in the third and fourth WHEREAS clauses, page 1 , of said
Cooperation Agreement; and
WHEREAS, the City plans certain site and public improvements with
its funds for which non-cash grants-in-aid will be claimed as credit
towards meeting the local share of the cost of the Central Little Rock
Urban Renewal Project; and
WHEREAS, the Housing Authority has submitted an Amendatory Appli-
cation for Loan and Grant in which the non-cash grants-in-aid and cash
grants-in-aid will be considered; and
WHEREAS, in view of the above, the Authority and the City are
desirous of entering into a Cooperation Agreement for the Central Little
Rock Urban Renewal Project, ARK R-12;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIREC-
TORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1 . That the execution of a Cooperation Agreement by and
between the Housing Authority of the City of Little Rock, Arkansas, and
the City of Little Rock, Arkansas, for the Central Little Rock Urban
Renewal Project, ARK R-12, dated March 19, 1974 attached hereto as
Exhibit "A, " be, and hereby is, in all respects approved.
Section 2. That the Mayor and City Clerk be and they are hereby
authorized to execute said Cooperation Agreement for and in behalf of
the City of Little Rock, Arkansas, and to take such further actions as
may be necessary to effectuate said Agreement.
Section 3. This Resolution shall be effective immediately.

COOPERATION AGREEMENT
by and between
THE HOUSING AUTHORITY OF THE CITY OF LITTLE ROCK, ARKANSAS
and
CITY OF LITTLE ROCK, ARKANSAS
(RE: CENTRAL LITTLE ROCK URBAN RENEWAL PROJECT, ARK R-12)
THIS AGREEMENT , entered into on the date last undersigned by and
between the Housing Authority of the City of Little Rock, Arkansas
(hereinafter called the Authority) , and the City of Little Rock, Arkansas
(hereinafter called the City) , WITNESSETH:
WHEREAS, it is desired to combine the High Street Urban Renewal
Project, ARK R-6, hereinafter, referenced as Phase II, with the Central
Little Rock Urban Renewal Project, ARK R-12, hereinafter referenced as
Phase I, for the purposes of financing and eventual close out, the com-
bined Project to be known as Central Little Rock Urban Renewal Project,
ARK R-12; and
WHEREAS, it is desired to cancel all previous Cooperation Agree-
ments between the Authority and the City for both Phases I and II, and
to replace them by this single superseding Agreement; and
WHEREAS, the undertaking of said combined Project will involve
gross project costs, federal, state and local, in the amount of approxi-
mately $4+1852 ,008.00, and . net project costs of approximately $25,091,173.00;
and
WHEREAS, the Department of Housing and Urban Development of the
United States of America will agree to pay an estimated $16,737 ,257.00 as
its two-thirds share in cash of said net project costs; and
G!IIEREAS, in payment of the City's share of the difference between
said net project costs and said expenditure of federal funds, the City
may receive credit for the provision of public improvements to. the extent
that they serve the combined Project Area; and
WHEREAS, the Authority and the City are desirous of reducing to
writing this statement of the intentions and undertakings of each in
connection with the consummation of said Central Little Rock Urban
Renewal Project, ARK R-12, including both Phases I and II;
NOW, THEREFORE, in consideration of the recitals hereof and of the
mutual promises and covenants herein set forth, the parties hereby agree
as follows:
1. The City Agrees:
a. To construct and install at its own cost, and furnish
certifications therefore where not already approved, noncash grants-in-
aid items as follows:

Central Fire Station, 7th and Chester $151,500.
b. Specifically, the City agrees that if, upon calculation
of the local one-third share of the net project cost at the close of
the Project, the sum of approved tax credits and approved noncash grants-
in-aid is less than the required local share, the City will provide the
balance in the form of cash. The City also agrees to provide through
appropriation ordinances the sum of $1,134,093. in cash which is the
estimated cash grant-in-aid portion of the one-third (1/3) share of the
net project cost, of which $1,000,801. have already been provided and
the remainder, or $133 ,292 , is to be paid to the Authority not later than
July 15 , 1974, for Project use in obtaining credit for Federal funds.
c. In Phase II, -carry out code enforcement on Parcels 176,
540, 300, 301, 648, and 1071 , that were originally scheduled for acquisi-
tion by the Authority but which have subsequently been deleted.
d. To purchase sub-surface rights of Disposition Parcels
B-7-1-PU and B-6-2-PU in Phase I from the Authority for $45,500. , for the
Auditorium Parking Garage and Plaza.
e. To provide as necessary, the right-of-way for, and the cost
of construction of, the Wright Avenue widening and relocation project
which lies outside the Project boundaries.

f. To accept dedication by the Authority of certain lands for
use as parks, plazas, open or landscaped areas, and improvements thereon
that may be accomplished by the Authority pursuant to the approved Project
Plans, and to continue their use for these purposes for a period of
twenty (20) years from and after date of said dedications; and to accept
other public improvements, such as streets, curb and gutter, sidewalks
and storm drainage, that may be accomplished by the Authority pursuant to
the approved Project Plans.
g. The City recognizes that Title VI of the Civil Rights Act
of 1964 and the regulations and policies of the Department of Housing
and Urban Development effectuating the Title and Executive Order 11063
prohibit discrimination on the ground of race, color, religion, sex or
national origin in the policies and practices of any public facility,
and on the ground of race, color, or national origin in the policies of
any educational institution, or hospital responsible for proposed credit
to the locality's share of the cost of an urban renewal project receiving
financial assistance from the United States. The City hereby assures the
United States and the Secretary of Housing and Urban Development that the
site improvements it may construct will be available to and serve all
persons without regard to race, color, religion, sex or national origin.
2. The Authority agrees to undertake and carry out the following
as provided in the approved_ Plans:
a. Acquisition of land to be used for parks, plazas and open
or landscaped areas as proposed by the Project Plans, including all improve-
ments situated thereon. In this connection, the Authority shall relocate
all residents and businesses; remove and demolish and clear all structures
from the site or sites of the proposed parks, plazas and open or land-
scaped areas, and dispose of said lands and any improvements made thereon
4 by the Authority to the City by dedication for ownership, operation and
maintenance.

b. To install, provide and construct as necessary and appropri-
ate and as required to implement and carry out the Project Plans all site
and project improvements, including but not limited to installation of
curbs, gutters, storm drainage, paving, landscaping, park and plaza improve-
ments, and other necessary incidental items, and upon completion to be
turned over to the City for operation and maintenance.
c. In addition, the Authority shall do all things and take all
actions necessary and appropriate to insure complete and final execution
of said Plans.
d. Specifically and included in the above, is the Library Plaza
at a cost of $78,984. ; the Auditorium Plaza, over the Public Parking Garage
constructed by the City, at an estimated cost of $1,020,000. ; the Main
and Capitol Plaza at an estimated cost of $75,000. ; and the streets and
storm drainage improvements in Phase II at a cost of $820,618.
e. To sell the sub-surface rights of disposition parcels
B-7-1-PU (Lot 12, Block 100, Original City of Little Rock) and B-6-2-PU
(Lots 7 , 8, and 9, Block 99, Original City of Little Rock) which will be
beneath the proposed Parking Garage and Plaza, to the City for $45,500.
3 . This Cooperation Agreement shall be terminated if at any time
the Department of Housing and Urban Development of the United States of
America determines that the Central Little Rock Urban Renewal Project
(Phases I and II) is not eligible for continued Federal financial assis-
tance under the provisions-of the National Housing Act of 1949, as amended.
IN WITNESS WHEREOF, the Authority and the City have caused this
Cooperation Agreement to be executed by their duly authorized officers
