5166 RESOLUTION NO 5,166 A RESOLUTION ACCEPTING THE RESOLUTION OF THE LITTLE ROCK SANITARY SEWER COMMITTEE AND PLEDGING THE CITY' S COOPERATION TO COMPLY WITH THE RECOMMENDATIONS OF SAID RESOLUTION DATED MARCH 6 , 1974 ; AND FOR OTHER PURPOSES BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . The Resolution of the Little Rock Sanitary 0 Y Sewer Committee dated March 6 , 1974 , a copy of which is attached hereto, pertaining to new construction and occupancy thereof connecting to sewers in the watershed of the Rock Creek Sewer System until the new sewer interceptor along the banks of Rock Creek is completed is hereby acknowledged and the City of Little Rock hereby commits itself to conform with the terms and provisions of said Resolution. SECTION 2 . This Resolution shall be in full force and effect from and after its adoption. ADOPTED: March 19, 1974 ATTEST: c !/!?4, APPROVED: LG% �� - City Clerk Mayor I I '0'f RESOLUTION WHEREAS due to the overflow of untreated sewage from manholes in the northwest portion of Little Rock, the Arkansas State Department of Health issued a directive on July 16, 1973 prohibiting additional extensions of sewer mains or connections of multi-family or significant commercial developments to sewers in the watershed of the Rock Creek sewer system. The Arkansas State Department of Health stated that this prohibition would be in effect until construction is complete on a new sewer interceptor along the banks of Rock Creek. Construction began on this sewer inter- ceptor January 28, 1974, and is scheduled for completion February 5, 1975, but it is reasonable to expect that given favorable weather conditions, construction will be complete to an extent to alleviate untreated sewage overflows in this watershed by the month of October 1974. The Arkansas State Department of Health has indicated that authority to issue connection permits and approve extensions in the Rock Creek watershed would be given allowing construction to commence if a procedure could be instituted to insure that the facilities constructed under these permits were not actually occupied or placed into use until the prohibition was discontinued follow- ing completion of the interceptor construction. NOW BE IT THEREFORE RESOLVED that the Sanitary Sewer Committee of the City of Little Rock, Arkansas, recommends to the Board of Directors of the City of Little Rock, Arkansas, the adoption of a policy regarding the issuance of building permits in the Rock Creek Watershed. (1) That a permit will be issued to an applicant following certification by the Wastewater Utility Manager that sewer service will be available as requested for the proposed project following completion of the interceptor sewer and lifting of the Arkansas State Department of Health prohibition. (2) That the applicant, as a condition of receiving the permit, acknowledges that he is aware that he cannot occupy the premises or otherwise discharge into his sewer connection until issuance of a certificate of occupancy by the Little Rock Community Development Department. (3) That this certificate of occupancy for the premises constructed under this permit shall not be issued until notification either by the Arkansas State Department of Health or by the Little Rock Wastewater Utility that the prohibition placed by the Arkansas State Department of Health for this portion of the water- shed of Rock Creek is no longer in effect. (4) That the applicant be made aware that a goal of completion and lifting of the prohibition by the month of October 1974, has been set, but no implied or written guarantee is given that he may in fact occupy the premises by that time and he cannot occupy his premises until the prohibition is lifted by the Arkansas State Department of Health.
