2 A RESOLUTION TO AUTHORIZE USE OF EMINENT DOMAIN ON
3 THE 40TH STREET PROJECT (KATHERINE STREET TO POTTER
4 STREET); AND FOR OTHER PURPOSES.
5 WHEREAS, attempts to acquire some right -of -way and temporary construction
6 easements necessary for construction of the 40th Street Project (Katherine Street to Potter
7 Street) have been unsuccessful, and
8 WHEREAS, efforts will continue to acquire necessary property without the use
9 of eminent domain, and
10 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
11 THE CITY OF LITTLE ROCK, ARKANSAS:
12 Section 1. The City is authorized to use eminent domain to complete acquisition
13 of right -of -way for this project.
14 Section 2. Funding for acquiring this property is available in Account 314 -220-
15 SR08.
16 Section 3. This resolution shall be in full force and effect from and after its
17 adoption.
