A RESOLUTION PRESCRIBING AND ESTABLISHING CERTAIN
RULES , REGULATIONS , TERMS , CONDITIONS , DUTIES ,
RESPONSIBILITIES , RIGHTS AND PRIVILEGES AS RELATED
TO THE EMPLOYMENT AND/OR RETENTION OF A PERSON TO
SERVE AS A TENNIS PROFESSIONAL AT THE WALKER TENNIS
CENTER; AND FOR OTHER PURPOSES
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS .
SECTION 1 . Effective March 1 , 1973 that the person employed
and/or retained by the City of Little Rock as a tennis professional
will be controlled by , subject to, and have the rights and privileges
all set forth as follows :
A. Salary to be paid by the City :
1st year $4 , 800 .00 annually
2nd year $4 , 200 . 00 annually
3rd year $3 ,600 . 00 annually
B . The tennis professional and/or only his designated
representative shall have the exclusive right to give tennis lessons
at the Walker Tennis Center at a fee not to exceed $6 .00 per half
hour or $12 .00 per hour, unless otherwise approved by the City , and
retain all such revenue unto himself. The tennis professional is
expected to provide these services on a yearly basis and to build
and promote tennis programs . The tennis professional is expected
to provide group lessons . The fees charged for said lessons shall
be approved by the Parks and Recreation Department Director.
C . The tennis professional may employ such teaching assistants
as in his discretion may be needed with the understanding that such
assistants shall be paid entirely by the tennis professional .
D. An assistant professional will be employed and paid by
the City. Personnel for tournaments when necessary shall be paid
by the tennis professional as part of the tournament expense . The
City may establish a continuing public tennis program and will pro-
vide additional seasonal employees for the summer portion of such
tennis program. The professional will supervise such program and
employees and will dedicate the necessary time to accomplish the
objectives of such program.

E . The tennis professional shall be obligated to maintain a
satisfactory stock of goods in the Pro Shop and shall have the
exclusive right to sell such at the assigned tennis center and shall
offer same to the public at the customary markup over his cost .
F . The tennis professional shall keep and maintain an accurate
set of books in form prescribed by the Director of Finance or his
designated representative reflecting the operation of the tennis
concession . These books shall at all times be subject to inspection
by the Director of Finance . It shall be the duty of the tennis pro-
fessional to furnish either the Director of Finance or the Director
of Parks and Recreation any and all information requested concerning
the operation of the tennis center.
G. The tennis professional shall be entitled to such number
of days off as provided for all other City employees , but may select
days other than Saturday and Sunday for days off during the week and
may select an alternate day for any holiday on which a tournament or
other scheduled event shall occur. The tennis professional shall be
expected to comply with all rules and regulations governing employee ' s
conduct as set forth by applicable City regulations .
H. The tennis professional shall devote his entire time and
attention to the discharge of his duties in the job description as
professional at the tennis center.
I . The tennis professional shall initiate and promote tennis
activities for the general public and conduct all tennis tournaments
held at his assigned tennis center. In this connection the tennis
professional shall cooperate with , and be responsible to , the
Director of Parks and Recreation of the City .
J. The tennis professional shall abide by and enforce all
regulations of the City applicable to the premises of his assigned
tennis center.
K. The tennis professional shall pay and remit to the City not
later than the 10th day of each calendar month a sum equal to 5% of
the gross receipts , (exclusive of state sales tax) for all items sold
from the Pro Shop of his assigned tennis center. Payment shall be
made to the Finance Department of the City.

L. The tennis professional shall pay in advance to the City
an annual rental of $ 1 . 50 per square foot for Pro Shop sales area
and storage area. Until changed by the Board of Directors , the
following square footage figure shall be the basis for computing
the rent due hereunder :
Walker Tennis Center . . . 100 square feet
M. The tennis professional shall be responsible for keeping
the building and courts clean , neat, and orderly . The City will
furnish all cleaning supplies and nets and will be responsible for
maintenance to the building and courts . The tennis professional or
his designated representative is expected to do all janitorial work
at the center and to clean the courts when necessary .
N . All lockers at the tennis center shall be provided by the
City and all revenue received therefrom shall be paid directly to
the City when collected.
O . The tennis professional shall promote and conduct at least
six (6 ) tennis tournaments per year at the assigned tennis center

and collect entry fees as mutually agreed upon between himself and

the City , 25% of which shall be remitted to the City as its share
thereof and 75% retained by the tennis professional .
P . All receipts from court fees , drink machines , and locker
rental shall be paid to the City.
Q. The tennis professional shall maintain strict control over
the proper accounting for all fees , rentals , and other receipts at
' the assigned tennis center in accordance with practices and procedures
approved by the Finance Department of the City of Little Rock . The
Finance Department of the City shall assist the professional in
t setting up and maintaining proper accounting records .
SECTION 2 . This Resolution shall be in full force and effect
from and after its adoption .
