A RESOLUTION AUTHORIZING THE DEPARTMENT OF COMMUNITY
DEVELOPMENT OF THE CITY OF LITTLE ROCK TO ASSIST THE
LITTLE ROCK MUNICIPAL WATER WORKS IN OBTAINING COM-
PLIANCE WITH THE STATE PLUMBING CODE ; AND FOR OTHER
PURPOSES
The Little Rock Municipal Water Works is owned by the City of
Little Rock but is operated by a Board of Commissioners which has
statutory powers to adopt rules and regulations for the waterworks
system. The Water Works renders service inside and outside the City
boundaries through an integrated distribution system. Improper de-
sign , workmanship or materials in the construction of water and sewer
facilities can cause a back-flow or siphonage of contaminated materials
into the municipal waterworks system. After initial satisfactory con-
struction, the same result may occur due to obsolescence or improper
functioning, maintenance or repair. It is possible for contamination
of the water system outside the City to extend into the municipality
and injure the health and welfare of the citizens of Little Rock.
To reduce the risks of contamination , the Board of Water Works
Commissioners has enacted a resolution , dated May 26 , 1972 , to become
effective September 1, 1972 . That resolution adopts the Plumbing Code
of the State of Arkansas and Article 1 of the Little Rock , Arkansas
Mechanical Code as provided for by Chapter 30 of the Code of Ordinances
of the City of Little Rock except where the provisions of said Article 1
are in conflict with said State Code , as the standards of the Little
Rock Municipal Water Works and designates the Department of Community
Development of the City of Little Rock as the Water Works ' represen-
tative to determine that the State Plumbing Code has been complied with
in the installation and maintenance of water or sewer facilities on
property connected to the water system.
The Board of Water Works Commissioners has requested the Board of
Directors of the City of Little Rock to authorize the Department of
Community Development to perform the duties specified in the foregoing
resolution.
NOW THEREFORE , BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS.

SECTION 1. The Board of Directors of the City of Little Rock finds
that the statements contained in the preamble of this resolution are
true.
SECTION 2 . The Department of Community Development of the City
of Little Rock is hereby authorized and directed to perform the duties
delegated to it by the resolution of the Board of Water Works Commis-
sioners of the City of Little Rock , which resolution is dated May 26 ,
1972 , to become effective September 1, 1972 .

RESOLUTION
By a separate resolution of this date , entitled
"Compliance with the State Plumbing Code" , the Board of
Water Works Commissioners of the City of Little Rock has
adopted the Plumbing Code of the State of Arkansas and
Article 1 of the Little Rock, Arkansas Mechanical Code as
provided for by Chapter 30 of the Code of Ordinances of
the City of Little Rock except where the provisions of said
Article 1 are in conflict with said State Code , as the
standards of the Little Rock Municipal Water Works and has
designated the Department of Community Development of the
City of Little Rock as the Water Works ' representative to
determine whether the Code has been complied with. A copy
of that resolution is attached to and made a part of this
resolution.
The Board of Water Works Commissioners , therefore ,
requests the Board of Directors of the City of Little Rock
to adopt a resolution authorizing the Department of Community
Development to perform the duties specified in the foregoing
resolution.

RESOLUTION
BE IT RESOLVED by the Board of Water Works Commissioners
of the City of Little Rock that the following regulation is
hereby adopted:
COMPLIANCE WITH STATE PLUMBING CODE
1. Purpose of Regulation. Improper design , workmanship
or materials in the construction of water and sewer facilities
can cause a back-flow or siphonage of contaminated materials
into the municipal waterworks system. After initial satisfactory
construction , the same result may occur due to obsolescence or
improper functioning, maintenance or repair. To reduce such
hazards to public health and to insure the continued high quality
of water service to all of its consumers , this regulation is
adopted and shall be applicable to all connections to the Little
Rock Municipal Water Works system inside and outside the City
of Little Rock.
2 . Standards . All water and sewer facilities now or
hereafter installed on any premises connected to the waterworks
system shall be of a design, workmanship, materials and state
of repair that meet the minimum standards of the Plumbing Code
of the State of Arkansas . That Code is hereby adopted as the
standards of the Little Rock Municipal Water Works and the
obligation to comply with the Code shall be an implied condition
of all service contracts hereafter executed. This regulation
is applicable , but is not limited, to pipes , appliances , fixtures ,
septic tanks , control boxes and disposal fields.
3. Connection Requirements. Upon execution of a service
contract and upon compliance with all other applicable Water
Works rules and regulations , an applicant for water service shall
be entitled to be connected to the water system subject to the
provisions of this regulation.
4 . Department of Community Development. The Water Works
hereby appoints the Department of Community Development of the
City of Little Rock as its representative to determine whether

the State Plumbing Code has been complied with and to provide
the necessary permits and inspections . Before installing water
or sewer facilities on the property to be served, an applicant
must obtain a written permit from the Department of Community
Development. That Department may require the applicant to fur-
nish plans and specifications for the facilities , may refuse a
permit if the plans and specifications are not in compliance
with the State Plumbing Code , may inspect the premises from time
to time and disapprove the facilities if not in compliance with
the Code and may collect fees from applicants as reimbursement
for its services . Water Works representatives may also inspect
the facilities for the purpose of determining whether they are in
compliance with the Water Works ' rules and regulations.
5. Termination of Service. Even though a permit as afore-
said is issued to an applicant , if the Water Works or its repre-
sentatives determine that the facilities were not installed in
compliance with the State Plumbing Code , the Water Works may
terminate service. Even if initially installed in compliance
with the State Plumbing Code , water or sewer facilities may reach
such a state of obsolescence , disrepair or malfunction that they
constitute a hazard to public health. If such a condition exists ,
the Water Works shall have the right to terminate service
regardless of the date the facilities were constructed. In the
event of an emergency health condition , the Water Works may ter-
minate service without prior notice; otherwise, the Water Works
shall give fifteen (15) days ' prior written notice of the defect
before terminating service .
6 . Permit and Inspection fees and Charges. Permit and/or
inspection fees for water service outside the City as provided
for by this resolution are hereby fixed at one and one-half (12)
times those fees applicable for water works service inside the
City as set forth in the Little Rock , Arkansas Mechanical Code
provided for by Chapter 30 of the Code of Ordinances of the City
of Little Rock , Arkansas .

7. Effective Date. This regulation shall take effect
September 1, 1972.
