4637 RESOLUTION NO. 4,637 A RESOLUTION AWARDING A CONTRACT FOR THE CONSTRUCTION OF THE PARKING GARAGE AND RELATED IMPROVEMENTS; AND FOR OTHER PURPOSES. WHEREAS, invitation to bid was duly advertised and bids received pursuant thereto according to law for the construction of parking garage and related improve- ments; and WHEREAS, the lowest responsive and responsible bid has been determined and it is the desire of the Board of Directors to authorize the construction of said parking garage and related improvements by the lowest responsive and responsible bidder, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The lowest responsive and responsible bid on a contract to construct a parking garage and related improvements in the City of Little Rock is hereby accepted and a contract is hereby awarded to Pickens-Bond Construction Company, Little Rock, Arkansas, for a contract price not to exceed Two Million, five hundred sixteen thousand, nine hundred and six ($2,516,906,00) Dollars reserving unto the City the rights and options as provided for in the bidding specifications pertaining to alternates and/or change orders. The said contract is in form and substance as follows: A-E PROJECT NUMBER 67-019 AGREEMENT FOR MUNICIPAL PARKING GARAGE AND PUBLIC PLAZA THIS AGREEMENT made this 19th day of August, 1971 by and between Pickens-Bond Construction Company ( a corporation organized and existing under the laws of the State of ) Arkansas hereinafter called the "Contractor, " and CITY OF LITTLE ROCK, ARKANSAS, hereinafter called the "Owner, " Little Rock Municipal Parking Authority and The Housing Authority of the City of Little Rock, Arkansas. WITNESSETH, that the Contractor and the Owner for the considerations stated herein mutually agree as follows: ARTICLE 1 . Statement of Work. The Contractor shall furnish all supervision, technical personnel, labor, materials, machinery, tools, equipment and services, in- cluding utility and transportation services, and perform and complete all work required • for the construction of the improvements embraced in the Site Preparation; namely, the NEW MUNICIPAL PARKING GARAGE AND PUBLIC PLAZA, all in strict accordance with the Contract Documents for the construction of the Municipal Parking Garage and Public Plaza, including accepted ALTERNATES and all Addenda thereto, numbered #1 through #10 and Post Addendum #1 , dated June 9, 1971 , June 16, 1971 , June 18, 1971 , June 22, 1971 , June 30, 1971 , July 1 , 1971 , July 8, 1971 , July 8, 1971 , July 16, 1971 , July 20, 1971 , and August 18, 1971 , consecutively, all as prepared by CROMWELL, NEYLAND, TRUEMPER, MILLETT & GATCHELL, INC ., acting and in these Contract Documents for this Project, referred to as the Architect-Engineer. ARTICLE 2. The Contract Price. The Owner will pay the Contractor for the per- formance of the Contract, in current funds, subject to the ADDITIONS and DEDUCTIONS as provided in Section 109 hereof, the sum of Two Million Four Hundred Seventy One Thousand Six Hundred Sixty Eight and No/100 dollars ( $2,471,668.00 ) as follows: LUMP SUM PRICE FOR MUNICIPAL PARKING GARAGE $1,561 ,668.00 LUMP SUM PRICE FOR PUBLIC PLAZA $ 910,000.00 TOTAL LUMP SUM PRICE FOR PROJECT $2,471 ,668.00 Computed as follows: Base Bid: $2,444,000.00 ALT. Instructions to Bidders h. Technical Specifications e. Signed copy of Bid i. Drawings ( as listed in the Schedule of Drawings ) This Agreement, together with other documents enumerated in this ARTICLE 3, which said other documents are as fully a part of the Contract as if hereto attached or herein repeated, forms the Contract between the parties hereto. The City Manager and Director of Finance are hereby authorized to issue from time to time the necessary warrant or warrants in payment of the contract price for said work upon compliance by the contractor with all of the conditions requisite to progress payments and the final payment as called for in the bid documents. SECTION 3. The awarding of the contract provided for in Section 1 hereof is made upon the recommendation of the Little Rock Municipal Parking Authority and such contract shall be jointly executed by the said Parking Authority acting through its Chairman and Secretary and the City of Little Rock acting through the Mayor and City Clerk and the Little Rock Housing Authority acting through its Chairman and Secretary.
