4606 RESOLUTION NO. 4,606
A RESOLUTION WAIVING THE OPTION OF THE CITY
OF LITTLE ROCK TO ACQUIRE CERTAIN PROPERTY
SITUATED IN THE PROPOSED RIGHT OF WAY OF THE
WILBUR MILLS EXPRESSWAY EXTENDED LOCATED AT
BOLTON AND ROOSEVELT STREET'S ; AND FOR OTHER
PURPOSES .
WHEREAS, the City of Little Rock is unable from a financial
stand point at this time to acquire right of way within the
proposed East West Expressway Extended located at Bolton and
Roosevelt in this City; and
WHEREAS , the owner of said property has applied for a build-
ing permit to erect improvements on said property necessitating
according to the Ordinances of the City of Little Rock a determination
by the Board of Directors of intent to acquire the subject property
for said right of way purposes or waive said right and issue a
building permit for the improvements .
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS .
SECTION 1. The City of Little Rock hereby waives for the
time being its option to acquire property situated in the proposed
right of way of the Wilbur Mills Expressway Extended located at
Bolton and Roosevelt streets and more particularly described as
follows :
Part of Lot 1, Bruce Industrial Acres and Part of the NW4
of the NE4 of Section 13, T-1-N, R-12-W, all in Little
Rock, Pulaski County, Arkansas, described as : Beginning
at a point on the North Right of way line of East Roosevelt
Road 200 feet West of the SE corner of said Lot 1 , thence
North 307.8 feet to a point on the North line of said Lot
1, thence Westerly along said North line 82. 5 feet, thence
continue Westerly along said North line 100 feet, thence
continue Westerly along said North line 100 feet, thence
continue Westerly along said North line 31.5 feet, thence
West 63. 15 feet to a point on the Easterly Right of way
4 line of the CRI&P Railroad Factoria Lead Track, thence
Southeasterly along said right of way line 385,5 feet
to a point on the North Right of way line of East Roosevelt
Road, thence East along said right of way line 220 feet
to the Point of Beginning.
SECTION 20 In the face of the determination of the City as
set forth in Section 1 hereof those departments and agencys of the
City of Little Rock responsible in the premises are hereby authorized
and directed to process the building permit application of Doyle
Burkett acting for and on behalf of Burkett Trucking Company the
owner of the herein described real property, in the routine matter
disregarding the fact that said property is situated in the proposed
right of way for the said Expressway Extentione
SECTION 3, This Resolution shall be in full force and effect
from and after its adoption.
