4580 RESOLUTION NO. 4,580 A RESOLUTION AUTHORIZING AN AMENDMENT TO LEASE AND AGREEMENT DATED FEBRUARY 17 , 1971 , BETWEEN THE CITY OF LITTLE ROCK , ARKANSAS AND THE LITTLE ROCK MUNICIPAL PARKING AUTHORITY ( CALLED "CITY" ) AND CAMELOT INN- LITTLE ROCK, INC. ( CALLED "CAMELOT") ; AND FOR OTHER PURPOSES WHEREAS , The City and Camelot have discovered the desirability and need of amending certain property descriptions contained in Exhibit "A" to the Lease and Agreement between the parties dated February 17 , 1971 , and have mutually agreed to make said changes by an amendment to the said Lease . NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1. That certain Lease and Agreement between the City and Camelot Inn-Little Rock , Inc. dated February 17 , 1971 , and filed in the office of the City Clerk is hereby amended to reflect a new des- cription of Tract "D" as same is contained in Exhibit "A" to said Lease and Agreement and that portion of Tract "F" as same is contained in Exhibit "A" of said Lease and AGreement which amendment shall be in form and substance as follows , which the Mayor and City Clerk are here- by authorized and directed to execute for and on behalf of the City of Little Rock, Arkansas : AMENDMENT TO LEASE AND AGREEMENT This Amendment to Lease and Agreement made this day of , 1971, by and between the CITY OF LITTLE ROCK, ARKANSAS , and the LITTLE ROCK MUNICIPAL PARKING AUTHORITY, an administrative agency of the City of Little Rock , Arkansas , created and functioning pursuant to the provisions of Act 468 of the Acts of Arkansas 1949 (herein collectively called "City" ) , and CAMELOT INN-LITTLE ROCK , INC. , an Arkansas corporation (herein called "Camelot") . WITNESSETH WHEREAS , the City and Camelot have discovered the desir- ability and need of amending certain property descriptions -2- contained in Exhibit "A" to the Lease and Agreement between the parties dated February 17 , 1971 ; NOW THEREFORE , in consideration of the mutual covenants and undertakings herein contained, and in order to amend and conform certain property descriptions as recited above , the City and Camelot agrees as follows : 1. The description of Tract "D" as the same is contained in Exhibit "A" to the Lease and AGreement between the City and Camelot dated February 17 , 1971, is hereby amended to read as follows : Tract "D" A tract of land lying entirely within Lot 6 , Block 99 , Original City of Little Rock, more particularly described as follows : Beginning at the Northwest corner of Lot 6 , Block 99 , Original City of Little Rock, said point being at the intersection of the East R-O-W of Spring Street and South R-O-W of Garland Street; thence East 35. 0 feet along the North Line of Lot 6 to a point; thence South and parallel to the West Line of Lot 6 , 21. 0 feet to a point; thence West and parallel to the North Line of Lot 6 35.0 feet to a point on the West Line of Lot 6 and the East R-O-W of Spring Street; thence North 21. 0 feet along the West Line of Lot 6 to a point of beginning and thereby enclosing by description a tract of land containing 735 square feet, more or less . 2 . The description of Portion of Tract "F" as the same is contained in Exhibit "A" to the Lease and Agreement between the City and Camelot dated February 17 , 1971 is hereby amended to read as follows : Air Rights and necessary surface rights to permit construction and use of an auto ramp along the North portion of Tract "F" (as described below) which shall connect the elevated drive of Camelot Inn - Little Rock , Inc. to Conway Street. This auto ramp will slope from elevation 292 ' ±- ( MSL DATUM) at the west property line of Tract "F" to an elevation of 280 ' +(MSL DATUM) at the EAst property line of tract "F" . This auto ramp will be approximately 20 ' wide (north-south dimensions) . No structure may be constructed above the auto ramp area below elevation 304 (MSL DATUM) . Tract "F" is more particularly described as follows : A tract of land lying entirely within the R-O-W of Garland Street and Conway Street and North of -3- Lots 4 , 5 & 6 , Block 99 , Original City of Little Rock , more particularly described as follows : Beginning at a point on the new centerline of Conway Street 31. 5 feet east of the northeast corner of Lot 4 , Block 99 , Original City of Little Rock , said point being at the intersection of the South R-O-W of Garland Street extended east and the new centerline of Conway Street; thence West 116 . 5 feet along said R-O-W of Garland Street extended and along t es north lines of Lots 4 , 5 & 6 to a point which735 . 0 feet east of the west line of Lot 6 , said West line of Lot 6 also being the East R-O-W of Spring Street; thence North and parallel to said East R-O-W 51 feet to a point on the south curb of State Hwy #10 (La Harpe Blvd) ; thence easterly 116 . 5 feet along said Hwy #10 South curb line to its point of intersection with the new centerline (extended) of Conway Street; thence South 46 feet along said new centerline of Conway street to the point of beginning.
