RESOLUTION NO . 4,466
A RESOLUTION AWARDING A CONTRACT FOR FIRST
YEAR DRAINAGE IMPROVEMENTS (MODEL CITIES)
WITHIN THE CITY OF LITTLE ROCK, ARKANSAS,
AUTHORIZING PAYMENT; AND FOR OTHER PURPOSES .
WHEREAS , invitations for bids for first year drainage
improvements (Model Cities) in the City of Little Rock in
accordance with plans and specifications on file in the office
of the Purchasing Agent have been duly advertised and bids
received pursuant thereto, all in accordance with law; and
WHEREAS, the lowest responsible and responsive bid
received pursuant thereto has been determined to be that of
the Mehaffy Construction Company in North Little Rock, Arkansas,
and the Board of Directors is desirous of awarding a contract
to said successful bidder; and
WHEREAS, funding for aforementioned drainage improvement
will be provided through the U.S. Department of Housing and
Urban , Development and Model Cities Program.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. A contract is hereby awarded to Mehaffy
Construction Company, Inc. , North Little Rock, Arkansas, for
the first year drainage improvements (Model Cities) within the
City of Little Rock in the amount of $372,070.45 in accordance
with plans , specifications and bid proposal on file in the office
of the Purchasing Agent .
SECTION 2 . Said contract is subject to approval of
affirmative action program by the U. S. Department of Housing
and Urban Development and shall be in form and substance as
follows:

WITNESSETH: That for and in consideration of the payments and agreements
hereinafter mentioned, to be made and performed by the OWNER, the CONTRACTOR hereby 4'
agrees with the OWNER to commence and complete the construction described as follows:

their) own proper cost and expense to furnish all the materials, supplies, machinery : `
equipment, tools, superintendence, labor, insurance, and other accessories and ser-
vices necessary to complete the said project in accordance with the conditions and 4,
prices stated in the Proposal, the General Conditions, Supplemental General Con-
ditions and Special Conditions of the Contract, the plans, which include all maps, `t;;
plats, blue prints, and other drawings and printed or written explanatory matter
thereof, the specifications and contract documents therefor as prepared by Mehiburger
Engineers, Inc. , herein entitled the )A444i44 h /Engineer, and as enum- !-
erated in Paragraph 1 of the Supplemental General Conditions, all of which are made ‘ s '
a part hereof and collectively evidence and constitute the contract.
The Contractor hereby agrees to commence work under this contract on or before
a date to be specified in a written "Notice to Proceed" of the Owner and to fully ., F
complete the project within 200 consecutive calendar days thereafter. The Con-
tractor further agrees to pay, as liquidated damages, the sum of $ 50.00 for .,.'
each consecutive calendar day thereafter as hereinafter provided in Paragraph 19 of
the General Conditions. it
The OWNER agrees to pay the CONTRACTOR in current funds for the performance of ;
the contract, subject to additions and deductions, as provided in the General Con- .

SECTION 3 . Upon completion of the work provided for by
the contract authorizedin Section 1 hereof and satisfying in all
respects, plans, specifications and bid proposal on file in the
office of the Purchasing Agent, the City Manager and Director of
Finance are hereby authorized and directed to issue the necessary
warrant or warrants in payment of the contract price as monies
are provided by the U.S. Department of Housing and Urban Develop-
ment.
SECTION 4. This Resolution shall be in full force and
effect from and after its adoption.
