4452 0 RESOLUTION NO . 4,452 A RESOLUTION AUTHORIZING A LEASE AGREEMENT BETWEEN THE CITY OF LITTLE ROCK, ARKANSAS AND THE HOUSING AUTHORITY OF THE CITY OF LITTLE ROCK FOR CERTAIN PROPERTY LOCATED IN TUXEDO COURTS ADDITION LOCATED IN NE 1/4 SECTION 15 , T-I=N, R.-12-W, LITTLE ROCK , ARK- ANSAS ; AND FOR OTHER PURPOSES . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1. The Mayor and the City Clerk are hereby authorized and directed to execute a Lease Agreement with the Housing Authority of the City of Little Rock to lease from said Housing Authority certain real property in the Tuxedo Courts Addition located in the NE 1/4 Section 15 , T-I-N, R-12-W, Little Rock, Pulaski County, Arkansas being more particu- larly described as follows : (Commence at the intersection of the West Right-of-way line of Cumberland Street and the North Right-of-way line of East 29th Street , thence T'?est along said North Right-of-way line of East 29th Street 352 ° 1 feet to the point of beginning, thence continue West along said North right-of-way line 182 feet , thence North 110 feet, thence East Parallel to the North Right-of-way line of East 29th Street 182 feet, thence South 110 feet to the point of beginning, containing 0 .46 acres , more or less) to be used as a family service center in connection with Model Cities Program. Said Lease and Agreement shall be in form and sub- stance as follows : -2- LEASE AGREEMENT BY AND BETWEEN THE CITY OF LITTLE ROCK, ARKANSAS AND THE HOUSING AUTHORITY OF THE CITY OF LITTLE ROCK, ARKANSAS This agreement is herein made and entered into this day of , 19709 by and between the City of Little Rock, Arkansas, herein referred to as "City" and the Housing Authority of the City of Little Rock, Arkansas, herein referred to as "Housing Authority" for the purpose of the City utilizing the building owned by the Housing Authority located in the Tuxedo Courts Addition in the NE 1/4 Section 15 , T-I-N, R-12-W, Little Rock Pulaski County, Arkansas, being more par- ticularly described as (Commence at the intersection of the West Right- of-way line of Cumberland Street and the North Right-of-way line of East 29th Street, thence West along said North Right-of-way line of East 29th Street 352.1 feet to the point of beginning, thence continue west along said North right-of-away line 182 feet , thence North 110 feet, thence East Parallel to the North Right-of-way line of East 29th Street 182 feet, thence South 110 feet to the point of beginning, containing 0 .46 acres, more or less) to be used as a family service center in connection with the Model Cities Program. NOW, THEREFORE, the parties hereto mutually agree as follows : 1. The Housing Authority does hereby let , lease and demise the building located in the Tuxedo Courts addition in the NE 1/4, Section 15 , T-I-N, R-12-W, Little Rock Pulaski. County, Arkansas being more particularly described above, to the City for Five Dollars ($5 .00) and other valuable considerations . 2. The Housing Authority will make aiiilable to the City the equipment located in the building as indicated on the attached inventory. This equipment shall be the responsibility of the City; and damaged, lost or stolen equipment shall be replaced by the City with equipment of equal -3- quality, normal wear and tear excepted. 4 Y� o P 3 . The City agrees to provide space for the well-baby clinic but re- serves the right to determine which days shall be available for said clinic . 4. The City agrees to use the building as described above only as a Family Service Center or as similar thereto as the City shall deem appropriate during the term of this lease . 5 . The City will provide repair, maintenance and all janitorial ser- vices for the building including all yard maintenance during the term of this lease. 6. The City agrees to provide Fire and Extended Coverage insurance in an amount not less than $70,000.00 to cover the value of the building during the term of this lease. 7. The City agrees to provide all utilities necessary for the operation of the building during the term of this lease. 8 . The City agrees to provide an office in the building for occupancy by the management staff of the Ives Homes F.ousing Project. 9 . The City understands and expressly agrees that any permanent improve- ments or additions made to the building or grounds during the term of this lease shall become the sole property of the Housing Authority upon expir- ation or termination of this lease . 10. The City hereby assumes responsibility for and agrees to hold the housing Authority harmless for any personal injuries or property damage that may occur to or within the building or on the grounds by reason of negligence on the part of the City, its agents, serNants and employees . This agreement shall be in full force and effect from and after the date of execution and shall extend for a period of five (5) years . Thereafter, this lease may be renewed on a year to year basis -4m at the option of the City of Little Rock, Arkansas for One Dollar ($1.00) and other good and valuable considerations, per year. This lease may be cancelled at any time upon mutual agreement by both parties .
