RESOLUTION NO. 4,440
A RESOLUTION VACATING, CLOSING AND
ABANDONING A PART OF THE STORM
DRAINAGE EASEMENT OVER AND ACROSS
LOT 1, BLOCK 26, CENTENNIAL ADDITION
TO THE CITY OF LITTLE ROCK; AND FOR
OTHER PURPOSES
WHEREAS , the owner of Lot 1, Block 26, Centennial Addition,
has inadvertently constructed a residential structure upon a part
of a previously granted public storm drainage easement across said
property and now requests the City of Little Rock to vacate and
abandon such of said easement as the said residential improvement is
situated on; and
WHEREAS, the Board of Directors desires to grant the request of
the owner of said property conditioned that the City is relieved and
held harmless from any accountability and responsibility for damage
which may occur through the continued use of said facility for
drainage purposes and/or the maintenance and upkeep of said facility.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
4 CITY OF LITTLE ROCK, ARKANSAS .
SECTION 1. The Mayor and City Clerk are hereby authorized and
directed to execute a Release of Drainage Easement to a part of
Lot 1, Block 26, Centennial Addition to the City of Little Rock,
Arkansas, more particularly described as follows:
Beginning at the northeast corner of Lot 1,
Block '26, Centennial Addition; thence westerly
along the south right-of-way of West 15th Street
5 feet to a point; thence southerly along a line
5 feet west of and parallel to the east line of
Lot 1, Block 26, Centennial Addition to the north
wall of a brick structure; thence westerly along
the north wall of said structure to its northwest
corner; thence southerly along the west wall of
said structure to its southwest corner; thence
easterly along the south wall of said structure
to a point, said point being the intersection of
a line 5 feet west of and parallel to the east
line of Lot 1, Block 26, Centennial Addition and
the south wall of the said brick structure, thence
run southerly along a line being 5 feet west of and
parallel to the said east line of said Lot 1 to
its intersection with the south line of Lot 1,
Block 26, Centennial Addition; thence run easterly
along said south line to the southeast corner of
said Lot 1, thence run northerly along the east
line of said Lot 1 to the point of beginning,

SECTION 2. The Release of Easement shall contain a provision
relieving and holding the City harmless from any damage that may be
occasioned or result from the continued use of the existing facility
for storm drainage purposes as constructed and/or the maintenance
thereof both as relates to the portion of the easement herein aban-
doned and the portion of the easement not abandoned.
SECTION 3. This Resolution shall be in full force and effect
from and after its adoption.
