A RESOLUTION GRANTING TO ELIJAH SIMMONS
DISABILITY RETIREMENT BENEFITS UNDER
SECTION 2-24 OF THE CODE OF ORDINANCES
OF THE CITY OF LITTLE ROCK; AND FOR
OTHER PURPOSES
WHEREAS , Elijah Simmons was employed by the City of Little Rock
on August 18, 1945 and was continuously employed until August 28, 1970,
at which time Mr, Simmons retired due to a physical disability and is
found to be entitled to disability retirement benefits comprising a
term of 25 years and 10 days; and
WHEREAS , under Section 2-24 of the Code of Ordinances of the City
of Little Rock, it is the policy of the Board of Directors to continue
to pay disabled employees at the rate of pay on the date of retirement,
and in this case for a period of 25 months and 10 days commencing
August 29, 1970; subject, however, to deductions from said monthly pay
equal to the aggregate of sums hereinafter received by Elijah Simmons
or to which he would be entitled provided he filed proper application
under the non-uniform employment plan with Mutual of New York, together
with such funds as shall be received hereafter monthly by said Elijah
Simmons or that which he would receive had proper application been
filed, if any, as disability benefits under the Social Security Adminis-
tration Program of the United States of America.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The City Manager and Director of Finance are hereby
authorized and directed to continue the salary established for Elijah
Simmons as of August 29 , 1970, for a period of 25 months and 10 days.
Provided, however, the monthly benefits herein authorized shall be
reduced by the amount that the said Elijah Simmons receives or would
receive had application been made monthly as benefits for non-uniformed
employees authorized under contract with Mutual of New York; and provided
further that six months from the date of said retirement said benefits
will be reduced additionally by the amount of benefits received or

which would be received had application been made from the Social
Security Administration of the Federal Government.
SECTION 2. Elijah Simmons shall be required to make available
to the City Manager an accounting of all monies received from Mutual
of New York under the city' s non-uniformed benefits plan and from
the Social Security Administration of the Federal Government.
SECTION 3. This Resolution shall be in full force and effect
from and after its adoption.
