4425 RESOLUTION NO. 4,425 A RESOLUTION WAIVING COMPETITIVE BIDDING FOR PARTS AND REPAIR TO THE CUMMINS DIESEL ENGINE OF THE GALION T500 MOTOR GRADER USED BY THE PUBLIC WORKS DEPARTMENT: AUTHORIZING CONTRACT FOR SAID PARTS AND REPAIR; AND FOR OTHER PURPOSES. WHEREAS , the Cummins Diesel Engine on the Galion T500 Motor Grader in use by the Public Works- Department- has- suffered mechanical failure which must-be repaired- immediately; and WHEREAS, the only source of supply for parts necessary to make the repairs is Cummins Diesel Sales Corporation, 6700 Interstate Drive , Little Rock, Arkansas; and WHEREAS, the situation created by the limited source of supply for repair parts and the necessity for immediately making said repairs creates an exceptional situation which the Board of Directors determines to justify waiving competitive bidding and to award a contract to Cummins Diesel Sales Corporation to furnish the parts and make the repairs to said engine at a cost to the City not to exceed the sum of $4400 . 00 . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1. Cummins Diesel Sales Corporation, 6700 Interstate Drive, Little- Rock, Arkansas , is hereby awarded- a contract to furnish the necessary- parts- to-make- the` repairs to- the Cummins- Diesel Engine on the Galion T500 Motor Grader. used- by. the- Public Works' Department at a cost not to exceed $4400. 00- or- if said engine is not repairable for the purchase of a new Cummins Diesel Engine for said Grader. SECTION 2. The Board of Directors finds and determines that the limited source of supply for the parts needed to repair the tractor herein identified and the necessity for making said repairs immediately creates an emergency and an exceptional situation and, therefore, competitive bidding is hereby waived. SECTION 3. The cost of the repairs and/or purchase authorized in Section 1 hereof shall be made from appropriations heretofore provided for said purpose, in- the- 1970 Budget for the City of- Little Rock. r -2- SECTION 4 .
