A RESOLUTION AUTHORISING AND DIRECTING THE MAYOR
AND CITY CLERK OF THE CITY OF LITTLE ROCK, ARKANSAS,
TO JOIN IN A WRITTEN AGREEMENT WITH THE OWNERS OF
ALL THE REAL ESTATE IN BLOCK 291, ORIGINAL CITY OF
LITTLE ROCK, ARKANSAS, TO CLOSE AND ABANDON THE ALLEY
IN AND ACROSS SAID BLOCK; FINDING THAT SAID ALLEY IS
NOT NEEDED FOR HIGHWAY PURPOSES; THAT THE WELFARE OF
THE CITY WILL BE ENHANCED OR PROMOTED BY THE CLOSING
OF SAID ALLEY; AND FOR OTHER PURPOSES.
WHEREAS, it appears that the owners of all the real
estate in Block 291, Original City of Little Rock, Arkansas,
have determined to close and vacate the alley in and across
said block and attach the same to the abutting lots in said
block; and have agreed to the joint execution of acts of
agreement to accomplish said purposes; and
WHEREAS, it appears that said alley situated in and
across said Block 291, Original City of Little Rock, Arkansas,
is not needed for highway purposes, and that the welfare of
the City will be enhanced or promoted by the closing and
abandoning of said alleyway;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1 . It is hereby found and determined that
said alley in and across said Block 291, Original City of
Little Rock, Arkansas, is not needed for highway purposes and
that the welfare of the City will be enhanced or promoted
by the closing and abandoning of said alley.
SECTION 2 . That the Board of Directors of the City
of Little Rock, Arkansas, acting by and through the Mayor and
City Clerk of the City of Little Rock, shall join with the
owners of all the real estate situated in Block 291, Original
City of Little Rock, Arkansas, in a written agreement to close
and abandon the alley in and across said Block 291, Original
City of Little Rock, Arkansas, which agreement, in form, is
as follows :
"WHEREAS, there is an alleyway across the
middle of Block 291, Original City of Little Rock,
Arkansas, being parallel to West Capitol Avenue
and West Sixth Street, and running from Ringo
Street through said Block 291 to Cross Street; and
"WHEREAS, Southwestern Bell Telephone Company,
a corporation, is the owner in fee simple of all the
real estate in the above-described block; and
"WHEREAS, Arkansas ,Power & Light Company, a
corporation, is the owner of certain facilities
situated over, along, upon and across the above-
described alley; and
"WHEREAS, the Board of Directors of the City
of Little Rock, Arkansas, by Resolution No .
duly adopted and approved on the day of
1970, has found and determined
that said alley in and across said Block 291,
Original City of Little Rock, Arkansas, is not
needed for highway purposes and that the welfare
of the City will be enhanced and promoted by the
closing and abandoning of said alley and has
determined to join with the owners of all the real
estate situated in said Block 291, Original City
of Little Rock, Arkansas, in a written agreement to
close and abandon the whole of said alley and has
authorized the Mayor and City Clerk of said City
to enter into said agreement for and in behalf of
said City.
"NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
"That the parties hereto do hereby agree that
the above-described alleyway in Block 291, Original
City of Little Rock, Arkansas, shall be and it is
hereby closed, abandoned and vacated; that the right
of the general public and the owners of property
abutting upon said vacated alleyway to use the lands
embraced therein as an alley are forever cancelled
and barred; and that the title to the property wherein
said vacated alleyway is situated shall hereby be
vested in the owners of the real estate adjacent
thereto forever free of the lien of all persons to
use said lands as an alleyway .

SECTION 3 . That upon the proper execution and
acknowledgment of said instrument and the filing of the
same in the office of the Recorder of Pulaski County,
Arkansas, the title to the land comprising said alley so
vacated and abandoned is vested in the owners of the real
estate adjacent thereto .
