4298 RESOLUTION NO. 4,298 A RESOLUTION GRANTING TO THEODORE E. HERING DIS- ABILITY RETIREMENT BENEFITS UNDER SECTION 2-24 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. WHEREAS, Theodore Hering was employed by the City of Little Rock on January 28 , 1956, and was continuously employed until December 18, 1969, at which time Mr. Hering retired due to a physical disability and was found to be entitled to disability retirement benefits comprising a term of 13 years , 10 months and 20 days; and WHEREAS, under Section 2-24 of the Code of Ordinances of the City of Little Rock, it is the policy of the Board of Directors to continue to pay disabled employees at the rate of pay on the date of retirement and in this case for a period of 13 months and 27 days , commencing December 18 , 1969; subject, however, to deductions from said monthly pay equal to the aggregate of sums hereinafter received by Theodore Hering or to which he would be entitled provided he filed proper application under the non-uniformed employment plan with Mutual of New York, together with such funds as shall be received hereafter monthly by said Theodore Hering or that which he would receive had proper application been filed, if any, as disability benefits under the Social Security Administration Program of the United States of America. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1. The City Manager and Director of Finance are hereby authorized and directed to continue the salary established for Theodore Hering as of December 18 , 1969 , and to pay same monthly in the nature of disability retirement benefits beginning December 18 , 1969 , for a period of 13 months, 27 days . Provided, however, the monthly benefits herein authorized shall be reduced by the amount that the said Theodore Hering receives or would receive had application been made monthly as benefits for non-uniformed employees authorized under con- tract with Mutual of New York; and provided further that six months from the date of said retirement said benefits will be reduced additionally -2- by the amount of benefits received or which would be received had applica- tion been made from the Social Security Administration of the Federal Government. SECTION 2 . Theodore Hering shall be required to make available to the City Manager an accounting of all monies received from Mutual of New York under the city ' s non-uniformed benefits plan and from the Social Security Administration of the Federal Government.
