4169 RESOLUTION NO. 4,169 A RESOLUTION AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE ON BEHALF OF THE CITY OF LITTLE ROCK A RELOCATION CONTRACT WITH THE LITTLE ROCK HOUSING AUTHORITY; AND FOR OTHER PURPOSES . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1. The City Manager and City Clerk are hereby authorized and directed to execute with the Little Rock Housing Authority a relocation contract which shall be in form and substance as follows: ...._..... ....... ..........,..:..r..... ,.,.�.,r«...n.,..r..u.a..w.arnut.«.w.n.nrnrM:.a.;w.+.ir;....,w•..: JIWMSt'.u,Nf{w�i�Nir�lll�Z;'.1�l�i sY+M�i!�w1ai.+�RF..y1+.ti...:i'1F^!77'�+I 11�Y'MNSi�.�f".� �.._.C,�."tl�.'�Y''1'rM�' CONTRACT FOR RELOCATION SERVICES AGREEMENT This AGREEMENT entered into as of this Ilth day of March, 1969, by and between the City of Little Rock, a municipal corporation situated in Pulaski County, Arkansas, (hereinafter referred to as "City") and the Housing Authority of the City of Little Rock, (hereinafter referred to as the "Housing Authority) for the expressed purpose of providing Relocation Service to and for the City of Little Rock for any and all purposes. WITNESSETH : THAT the City and the Housing Authority acting by and through their duly authorized officers for the consideration stated herein, mutually agree as follows : I . SCOPE OF SERVICES A . The City will perform the following functions and duties : I . Prior to the execution of any HUD-Assisted project apprise the Housing Authority of the scope of the program and functions. Provide information obtained from surveys including the number of families, indivi - duals and business concerns that will be displaced. Furnish required and necessary data to ensure that eligibility may be determined for : a. Moving Expenses and Direct Loss of Property b . The Additional Relocation Payment c. Replacement Housing Payment d. Small Business Displacement Payment 2 . In order to ensure that the occupants and/or owners of property are informed about the proposed project , the City will prepare and distribute informational material no later than the date the City Board of Directors approve the Plan . 3 . As soon as practicable after acquisition of property issue to the Housing Authority a Notice to Proceed which notice will clearly and accurately set forth the following : a . Name of site occupant to be relocated b. Address of site occupant to be relocated c. Date property was acquired d. Owner or tenant occupant 4 e. Assume the required Property Management functions relating to the establishment of fair rent rates and rent CO I I ect i ons. Provide the necessary mat nt- (•nance ser•v i ces to ensure the health, safety and protection of the site occupants. 5. Certify Relocation Claims and make payments. 6. The City must provide funds to be deposited in the Housing Authority Revolving fund for the reimbursement of relocation services, on an actual cost basis. B. The Housing Authority will provide to the City a Schedule of Fixed Relocation Payments, Schedule of Average Annual Cross Rentals, Schedule of Prices . for Standard Sales Housing in the Locality and Informational Statements for Families, Individuals and Businesses, and will perform the following functions and duties after the re- ceipt of a Notice to Proceed : I . Deliver Informational Statements explaining the relocation assistance available. 2. Refer families and individuals to standard housing . 3 . Refer business concerns to available commercial spaces and, if appropriate to the Small Business Administration . 4. Perform duties necessary to assist site occupants to obtain and occupy housing that is decent, safe and sanitary, within their financial means, situated in reasonably convenient locations, with a minimum hardship to the site occupant . 5 . Inspect relocation housing units . 6 . Prepare claims to the City for certification and payment . II . TIME OF PERFORMANCE The services of the Housing Authority are to commence on March II , 1969, and sha I I be undertaken and completed in such sequence as to assure their expeditious completion in the light of the purposes of this Contract . III . COMPENSATION Compensation on an actual cost basis, shall be made by the City to the Housing Authority for research, preparation and cost of printing of schedules ti and documents necessary to fulfill the provisions of this Contract and for • the performance and services as outlined in Section I . The City will pay for the relocation services provided by the Housing Authority on a monthly basis upon receipt of an itemized statement of services rendered hereunder. The City will advance funds to the Housing Authority to cover at least one month 's anticipated expenditures for relocation services. B. It is expressly understood and agreed that in no event will the total compensation and reimbursement, if any, to be paid hereunder exceed the maximum sum of $75 .00 per family or individual and $ 100 per business for all of the services required. V. LIMITAI IONS I . It is mutually understood and agreed that no person lawfully occupying property shall be required to surrender possession without at least 90 days ' written notice. 2. The City will not press negotiations with an owner who has not been in occupancy of his dwelling for one year, which action would pre- clude his eligibility for a Replacement Housing Payment . 3. The above conditions and provisions of this Contract for relocation services will remain in full force and effect unless amended or modified, in writing, by the parties hereto.
