3848 RESOLUTION NO. 3, 848 A RESOLUTION GRANTING UNION NATIONAL BANK OF LITTLE ROCK, ITS SUCCESSORS AND ASSIGNS, THE PRIVILEGE TO USE CERTAIN SPACE UNDER THE EXISTING SIDEWALKS ADJACENT TO BLOCK 75 TO THE ORIGINAL CITY OF LITTLE ROCK AND THE ALLEY IN SAID BLOCK; AND FOR OTHER PURPOSES . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The Union National Bank of Little Rock, its successors and assigns, are hereby granted the privilege to excavate and use certain space under the existing sidewalks on Louisiana Street and West 4th and West 5th Streets west of the alley and the alley, all adjacent to the West one-half (0) of Block 75 of the original City of Little Rock, Arkansas, for use in construction of a building to be erected upon said property and as space for parking automobiles. The property to be used for such purposes is described as follows : Part of a 20.0 foot alley in Block 75 ORIGINAL CITY OF LITTLE ROCK, ARKANSAS , more particularly described as : Beginning at the NE Corner of Lot 1, Block 75 ORIGINAL CITY OF LITTLE ROCK, ARKANSAS; thence south parallel to the west line of said alley 31 -2"; thence east parallel to the north line of said Block 75 2' 8" ; thence south parallel to the west line of said alley 34' 8"; thence west parallel to the north line of said Block 75 2' 8"; thence south parallel to the west line of said alley 103' 72" ; thence east parallel to the north line of said Block 75 2' 8" ; thence south parallel to and 2' 8" east of the west line of said alley 34' 8"; thence west par- allel to the north line of said Block 75 0w 8"; thence south parallel to and 2' 0" east of the west line of said alley 89' 21" ; thence east parallel to the north line of said Block 75 2' 8" ; thence south parallel to and 5' 0" east of the west line of said alley 34' 8" to a point on the south line of Block 75; thence west along the south line of Block 75 5' 0" to the southeast corner of Lot 6, Block 75 ; thence north along the west line of the alley in Block 75 300' 0" to the point of beginning, containing 535.91 square feet more or less. AND Part of Louisiana Street lying adjacent to Block 75 ORIGINAL CITY OF LITTLE ROCK, ARKANSAS, more particularly described as : -2- Commencing at the northwest corner of said Block 75; thence south along the west line of said Block 75 6' 0" to the point of beginning; thence west parallel to the north line of said Block 75 12' 0'!; thence south par- allel to and 121 0" west of the west line of said Block 75 291' 0" ; thence east parallel to the north line of said Block 75 12' on to a point on the west line of said Block 75; thence north along the west line of said Block 75 291' 0" to the point of beginning, containing 3482.0 square feet more or less. AND Part of West Capitol Avenue lying adjacent to Lot 6, Block 75 ORIGINAL CITY OF LITTLE ROCK, ARKANSAS, more particularly described as : Beginning at a point on the south line of Lot 6, Block 75, said point being 11 4 " east of the SW Corner of said Lot 6; thence south parallel to the west line of said Lot 6 12' 0"; thence east parallel to and 12' 0" south of the south line of said Lot 6 26' 11" ; thence north parallel to thecest line of said Lot 6 12' 0" to a point on the south line of said Lot 6; thence west along the south line of said Lot 6 26' 11" to the point of beginning, containing 323.04 square feet more or less. AND Part of West Fourth Street lying adjacent to Block 75 ORIGINAL CITY OF LITTLE ROCK, ARKANSAS, more particularly described as : Commencing at the Northwest corner of said Block 75; thence east along the north line of said Block 75 0' 4" to the point of beginning; thence north parallel to and 0' 4" east of the west line of said Block 75 12' 0"; thence east parallel to and 12' 0" north of the north line of said Block 75 84' 0"; thence south parallel to and 84' 4" east of the west line of said Block 75 12' 0" to a point on the north line of said Block 75; thence west along the north line of said Block 75 841 0" to the point of beginning, containing 1008.0 square feet more or less. Copies of a plat and drawing of the area prepared by Thomas E. Stanley, registered architect, dated January 5, 1967, have been delivered to the City for filing in the Community Development Department and in the office of the City Clerk. SECTION 2. This franchise shall extend only to such area as exists under the said existing sidewalks and shall not be construed to permit interference by Franchisee with any utilities existing or planned under the said sidewalks. -3- SECTION 3. The Franchisee shall, at its expense, cause the new sidewalks, as planned, to be constructed with such re- inforcements or supporting materials as in the judgment of the Arkansas Power and Light Company, its successors and assigns and the City of Little Rock will support any and all existing or future street lighting facilities situated or to be situated in the area of said sidewalks. SECTION 4. The excavation, the construction of lateral and overhead supports and all other phases of work in the area under the existing sidewalks shall be controlled and governed by the appropriate Ordinances and regulations of the City of Little Rock and be subject to inspection and approval of the City of Little Rock. SECTION 5. The Franchisee, its successors and assigns, shall, by accepting this franchise, assume full and primary liability and responsibility to the public for any and all damage sustained by the public resulting from the construction upon or use of the property hereinabove described. SECTION 6. The City of Little Rock hereby retains the right to revoke this franchise in whole or in part at any time the above property is needed for public purposes and the Franchisee, its successors and assigns, by accepting said franchise agree and shall be bound to restore said property to its condition prior to the excavation, all at its expense.
