A RESOLUTION PERTAINING TO RECENT COURT
DECISIONS AFFECTING LAW ENFORCEMENT: AND
FOR OTHER PURPOSES.
WHEREAS, certain recent decisions of the Supreme Court
of the United States of America have dealt with the subject of
certain rights of individuals upon being detained, arrested or
accused of criminal acts by police and local authorities; and
WHEREAS, the requirements of these court decisions, as
a practical matter, tend to frustrate and hinder local law enforce-
ment; and
WHEREAS, it appears possible to safeguard and protect
individual liberties within the meaning and spirit of the Constitu-
tion of these United States and yet not so stringently reduce the
effectiveness of local law agencies:
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Board of Directors of the City of Little
Rock, Arkansas, though unanimously endorsing the proposition that
no accused should be denied his legal and civil rights or be denied
the protection of the laws of both the United States of .America and
of the State of Arkansas, does hereby express its concern that the
formal and strict rules and requirements established in recent
decisions of the Supreme Court of the United States of America, as
applied to local law enforcement, will cause serious damage at
every local level throughout these United States and will aggravate
an already alarmingly high incidence of crime.
SECTION 2. The Senators and Congressmen from the State
of Arkansas, together with all others in a position to so act, are
urged to strive toward a legislative or constitutional solution to
this grave delimma to the end that both personal rights and effective
local law enforcement may each be preserved for the benefit of social
and moral progress within this nation.
SECTION 3. This resolution shall be in full force and
effect from and after its adoption.
