3594 r ' RESOLUTION NO. 3,594 A RESOLUTION .t.CCEPTING THE BID OF COTTON BELT GRAVEL CO. , INC. FOR CERTAIN LAND OWNED BY THE CITY OF LITTLE ROCK; AUTHORIZING THE SALE OF SAID LAND FOR A CONSIDERATION OF $66,600.00 ; AND FOR OTHER PURPOSES. WHEREAS , invi .a. ion to bid was duly published and bids received pursuant thereto for the sale by the City of Little Rock of 40 Acres of land in Gilliam Park pursuant to the authority of Resolution No. 3578 adopted May 16, 1966 ; and WHEREAS, the highest and best bid received for said land was the bid of Cotton Belt Gravel Co. , Inc. in the sum of $66,600.00 cash; and WHEREAS, it is the desire of the Board of Directors of the City of Little Rock to accept the said bid and to authorize the conveyance of the specified 40 acres of land to the said successful bidder for the above stated consideration; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS : SECTION 1. The hid of the Cotton Belt Gravel Co. , Inc. in the sum of $66, 600.00 for 40 acres of land, being in Gilliam Park in the City of Little Rock, as more specifically described in SECTION 2 hereof, is hereby accepted. SECTION 2. The Mayor and City Clerk are hereby author- ized and directed to execute for and in behalf of the City of Little Rock a deed conveying all of the right, title and interest of the City of Little Rock in said lands to Cotton Belt Gravel Co. , 4 Inc. and upon receipt of the Consideration of $66, 600.00 the City Manager is directed to deliver said deed fully executed to the Cotton Belt Gravel Co. , Inc. The Deed referred to in this section is in form and substance as follows : I ;j O I T L A I M D E E D KNOW ALL MEN BY THESE i'RESZNTS: wHEREAL, the City of Little Rock, `u1eski County, Arkansas, on the 20th day of June, 1966, by Resolution, authorized and directed the Mayor, together with tha City Clerk, to convey to Cotton Belt Gravel Co. , Inc. property in the City of Little Rock, Arkansas, hereinafter described: NOW THEREFORE, We, H.E. Henson, Jr. and Pauline G. Beeson, Mayor and City Clerk respectively of the City of Little Rock, Ark- ansas, a municipal corporation, organized, chartered and existing under authority of the laws of the State of Arkansas, for and in consideration of the sum of Sixty-Six Thousand Six Hundred and no/100 Dollars ($66,600.00) cash in hand paid, and other good and valuable consideration, the receipt of which is hereby acknowledged, acting for and in behalf of the City of Little Rock, Arkansas, do hereby convey, alien and quitclaim unto Cotton 9elt Gravel Co. , Inc. its successors and assigns forever, the following lands lying in the City of Little Rock, County of _ ulasici, State of ,Arkansas, to-wit: SW ; NE 4, Section 26, Township 1 North, Range 12 ;nest TO HAVE F-d TO HuL) the same unto Cotton .Belt Gravel Co. , Inc. and unto its successors and assigns forever, together with all and singular, the tenements, appurtenances and hereditaments thereunto belonging or in any wise appertaining. Grantee herewith covenants that it, its successors and assigns, shall not use or maintain the aforedescribed lands for any purpose other than for mining or quarrying purposes, and this covenant is intended, and shall be construed, as a :,:evenant running with the land.
