A RESOLUTION APPROVING SUIT TO REFORM
WATERWORKS PIPE LINE EASEMENTS
WHEREAS, due to engineering errors , the Board of
Commissioners of the Little Rock Municipal Water Works has
obtained certain pipe line easements which contain incorrect
descriptions ; and
WHEREAS , said easements were taken in the name of
the City of Little Rock, Arkansas, for the use and benefit of
the Little Rock Municipal Water Works; and
WHEREAS, the Water Works now wishes to institute
suit for the reformation of those instruments in an attempt
to obtain easements under the correct descriptions; Now,
Therefore,
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. That the Board of Commissioners of the
Little Rock Municipal Water Works is hereby authorized to
institute suit in its name and in the name of the City of
Little Rock and to pursue the litigation, or the compromise
thereof, through an attorney or attorneys to be selected by
the Water Works. This approval is granted upon condition that,
if any fees, costs , expenses or judgments are charged to the
City of Little Rock, the Board of Water Works Commissioners
shall promptly reimburse the City for any such sums the City
