3482 RESOLUTION NO . 3,482 A RESOLUTION EXPRESSING THE INTENTION OF THE CITY OF LITTLE ROCK, TO COOPERATE WITH THE HOUSING AUTHORITY OF LITTLE ROCK IN THE CON- STRUCTION OF SITE IMPROVEMENTS, INCLUDING THE WIDENING AND RECONSTRUCTION OF TWELFTH STREET WITHIN THE UNIVERSITY PARK URBAN RENEWAL AREA; AUTHORIZING PAYMENT FOR CERTAIN ENGINEERING SERVICES; AND FOR OTHER PURPOSES . WHEREAS, it is in the best interests of the City of Little Rock (hereafter called "City'' ) and its inhabitants to widen and reconstruct that portion of West Twelfth Street between University Avenue and Rock Creek; and WHEREAS, the Housing Authority of the City of Little Rock (hereafter called "Housing Authority") is now engaged in certain other site improvements and construction within the University Park Urban Renewal Area which includes said portion of West Twelfth Street, and can effect savings to the City and reduce traffic congestion and construction delays by letting contracts for all such widening, reconstruction and site improvements at the same time; and WHEREAS, the Housing Authority will acquire and dedicate all land necessary to provide right-of-way between University Avenue and Rodney Parham Road necessary for said purposes, which right-of-way shall be not less than 60 feet but may be up to 80 feet where the City determines such to be needed to construct the roadway, to be financially feasible and requests same; and, the City will provide the necessary y right-of-way between Rock Creek and Rodney Parham Road, and pay the cost of widening, resurfacing and reconstructing said portions of West Twelfth Street, in accordance with plans and specifications therefor, approved by the City of Little Rock; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS 4 OF THE CITY OF LITTLE ROCK, ARKANSAS;. - 2 - SECTION 1. That the Housing Authority be, and it is hereby authorized, to act as sole contracting agent in the letting of necessary construction and engineering contracts for the widening, resurfacing and reconstruction of West Twelfth Street from University Avenue to Rock Creek, as more fully described in the plans and specifications therefor. SECTION 2. The construction work herein provided for shall be done in compliance with requirements of the City, and Garver & Garver, Consulting Engineers for the City, and the plans and specifications therefor shall be approved by the City and Garver & Garver, Consulting Engineers for the City, prior to any request for bids thereon. The City shall concur in writing in the selection of the successful bidder prior to any award of a contract for the Project. Any Change Orders or other variations from such plans and specifications shall be subject to the prior approval of the City and Garver & Garver, Consulting Engineers for the City of Little Rock. SECTION 3. The City will pay to the order of the Housing Authority the amounts set forth in periodic estimates submitted to the Housing Authority by Blaylock, Cook, Threet & Associates, Inc. , Engineers, pertaining to the widening, resurfacing and reconstruction of Twelfth Street, including both engineering services and actual construction costs, such remittances to be within ten (10) days of receipt of estimates. ( The rates for engineering services for this construction project 4 shall not exceed the rates heretofore agreed to by Garver & Garver, Inc. , for this and other engineering services in this City. Provided further no engineering expense shall be incurred hereunder unless and until Garver & Garver, Inc. , in writing filed with the City Clerk, waives its right to be paid for the engineer- 4 ing services herein provided for. ) 4 - 3 - SECTION 4.
