3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO AN AGREEMENT WITH U.S. ARMY CORPS OF ENGINEERS TO
5 ACQUIRE LAND NEAR FOURCHE CREEK; AND FOR OTHER
6 PURPOSES.

8 WHEREAS,the United States Congress passed the Water Resources Development Act of 1986 (the
9 "Act")to address the huge loss of life and property that resulted from storm events; and,
10 WHEREAS, there was an initial appropriation from Congress in the amount over Thirty Million
11 Dollars($30,000,000.00)for the purpose of implementing the provisions of the Act; and,
12 WHEREAS, a portion of the appropriation addressed channel improvements on Fourche Creek and
13 some of its tributaries;
14 WHEREAS, the Act also provided for land acquisition and for the development of a nature
15 appreciation area in the Fourche Creek bottomlands; and,
16 WHEREAS,the City of Little Rock recently received an appropriation in the amount of$1.1 million
17 in order to continue the intent of the Act; and,
18 WHEREAS, funding is available from a federal appropriation that will be administered by the U.S.
19 Army Corps of Engineers; and,
20 WHEREAS, lands already acquired by the City will be made available to match the Federal
21 contribution; and,
22 WHEREAS,the Federal funding can be applied to land acquisition or park development; and,
23 WHEREAS, park development requires more funding than is available from Congress and what the
24 City of Little Rock can match; and,
25 WHEREAS, an additional 430 acres still need to be acquired in order to comply with Section 401 of
26 the Act; and,
27 WHEREAS,recent appropriation will allow acquisition of some of those acres needed.
28 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
29 OF LITTLE ROCK,ARKANSAS:
30 Section 1. The City Manager is hereby authorized to execute a Project Partnership Agreement with the
31 U.S. Army Corps of Engineers to acquire land near Fourche Creek, with funding to be available through a
32 Federal appropriation,together with City-owned land as a match.

1 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
2 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
3 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
5 resolution.
6 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same,that are inconsistent with
7 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
